Guest guest Posted January 23, 2012 Report Share Posted January 23, 2012 Dr. Medlin, If you didn't get an answer on this yet (and assuming you're talking about a PIP context): yes, it's lawful for the carrier to administer the patient's claim in any way they see fit, as long as it represents a reasonable effort to perform their obligations under the insurance policy. What's " reasonable " is pretty elastic, but I can say with high confidence that unless an adjuster is behaving in a patently shocking way (or something close) an insurer probably has no duty to change adjusters based solely on the request of the insured patient.
