Dr. Herrst:

I am a lawyer and frequently hire docs and other experts to testify. For what it is worth, a flat fee for testimony is typically what I see. But the fee will

vary depending on whether the testimony is going to be live at court (higher fee because you will likely lose an entire day of seeing patients) or a perpetuation deposition by video (lower fee because it occurs on schedule and you can work around it). The

fee may also increase if there is a significant amount of medical records to be reviewed prior to testimony.

Additionally, the lawyer will likely want to meet you prior to testimony to make sure both of you are prepared; the attorney will expect to pay for your time

at this meeting as well. This meeting, chart review or other tend to be done on an hourly basis.

I was approached today about being an expert witness in an upcoming legal proceeding. I have never had the pleasure of serving in this way, so some advice would be most welcome.

Fees - what is a ballpark fee schedule that would be appropriate for a chart review, pre-trial prep work and testifying? Do most of you charge a flat fee for this service or divvy it up a la carte?

Prepping to testify - any hints/tips/tricks?

I attended Dr. Saboe's mock trial at WSCC a few years ago and have already dug out my notes to review, but I would greatly appreciate any other wisdom you care to pass along.
