For what it is worth, a flat fee for testimony is typically what I see. But the fee will vary depending on whether the testimony is going to be live at court (higher fee because you will likely lose an entire day of seeing patients) or a perpetuation deposition by video (lower fee because it occurs on schedule and you can work around it). The fee may also increase if there is a significant amount of medical records to be reviewed prior to testimony. Additionally, the lawyer will likely want to meet you prior to testimony to make sure both of you are prepared; the attorney will expect to pay for your time at this meeting as well. This meeting, chart review or other tend to be done on an hourly basis. Good luck!
