I apologize for being the constant lurker but the fingers don't usually work too well to type responses. I was wondering if any of you could send me some links to sights that are user friendly concerning the Americans with Disabilities Act? I recently put in for a transfer at work to move back home to be near my family because physically I need the help and my boss put a 'freeze' on it. She also wants to transfer and she doesn't think it's fair for me to go first just because of my health. Meanwhile I've been getting worse since I was diagnosed in December. I just wonder what my options are in fighting this since I have documentation of numerous discriminatory comments that she has made reguarding my having RA. I don't want to cause any hassles at work but my place of employment has turned into a hostile work environment. I am so stressed out that she is going to be hard on me especially when I'm flaring. I still manage to climb up and down on ladders from fear of being yelled at, as once happened before. However, I'm afraid that I'm going to hurt myself just to avoid conflict. I work in retail which isn't always conducive to RA (what is???). I only stay right now because I'm not sure what my options are as far as insurance and pre-existing conditions. If anyone has any info on that topic also I would really appreciate that too. Thanks so much for " listening " to me ramble on. I would either call the main corporate office's human resources line or speak to her immediate superior. I would explain that you feel her hostile attitude is contributing to the severity of your illness, and emphasize that you do not want to have this all blow up into a major issue, you simply want to be transferred away from her and back to your support system. I would be ready to provide specific incidents where you feel she has treated you badly because of your RA. It is likely that your company will go along with the request. They want to avoid trouble and potentially embarrasssing, costly discrimination lawsuits. If they are unresponsive, you can call the ADA Help line. I copied the information from their web site below. They will be able to give you advice and explain exactly how to file an ADA complaint. Continue to take notes of specific incidents - being sure to note the date, time, and exactly what was said or done. Document (and provide that document to your employer) and follow your doctors advice, even if that means staying off ladders. The company is required to make reasonable adjustments, so you can probably get permission to avoid ladders, have a seat placed for you at an information desk or cash register, and lots of other things that can make it easier for you to do your job. Keep in mind, that the wheels of justice turn very slowly, but they do turn. So hang in there.
