We met with our lawyer for the first time about a medical malpractice case for our daughter. The lawyer has all of the medical records, and says that we have a good case for proving the malpractice. He also had some doctors look at her MRI, and could believe how much brain damage my daughter has. The lawyer is amazed that her only problem seems to be speech. There are 2 really depressing things. 1 is that the cap for damages in California is only $250,000. We can also sue for reimbursement expenses. The only thing is that our side will try to prove that will never be able to go to college. If we prove that she can't go to college, then she will get lots of money for lost wages. She going to be seen by a neurologist that the lawyer knows. Then when she is 6, the lawyer wants to have her evaluated by a neuro- psychologist. I know that this doesn't mean that won't go to college, but it is still very depressing. Sometimes I wish that we didn't have to pursue the malpractice case, but it will be good for her to get the money. Of course, we won't get any of this for many more years.
