The first thing to do is remember that your bus driver is only doing what he has been told. You need to go over his head. Find out who is in charge of special ed transportation and go to him/her with your issues. 1. When talking to the supervisor about the length of the bus ride, stress how the long bus ride will adversely affect your child's performance in school and behavior on the bus. IF the supervisor is unwilling to make changes to your child's bus schedule and you believe it will adversely affect his performance and behavior in school then I would recommend you request, in writing, an IEP meeting to discuss your child's transportation needs. Ask that a reasonable time on the bus be written into the IEP. (For example, ny will be on the bus for no longer than 30 minutes). Of course, you will have to take into account what a reasonable time is based on the distance from home to school. 2. Releasing " special-ed students " earlier than " regular-ed " students is discriminatory and a violation of your child's rights. Many schools and school systems routinely do this because it is easier for them AND because parents do not complain. When parents complain - they stop. I suggest you " remind " the teacher, the principal, the special ed director and the transportation director that it is specifically stated in your child's IEP that he is to remain in school until 3pm. You should do that in writing since school is about to start and you don't want to have them dragging their feet. I feel confident that they will quickly accommodate you. If not, you can file a complaint with the State Division of Exceptional Students. I would first try there and see if a compromise can be made. Guest guest Posted August 2, 2006 Report Share Posted August 2, 2006 I am only familiar with WV on this one, but maybe this will help. The state sets the required number of instruction per year. Special needs children can not be cheated on this any more than typical children can. The state should also have guidelines regarding transportation. I would call the state department of education and have them mailed to me under FOIA. The questions that come to my mind are.....Is your son in his home school?.......Is he receiving special transportation? Special transportation can be written into the IEP as a related service. Also, the bus driver has to be made aware of a behavior plan if one exists. Guest guest Posted August 20, 2006 Report Share Posted August 20, 2006 The issue is not what the bus regs are, it is what is written in your son's IEP. Think of it as your ruby slippers, and that one document can give you the power you need to solve this issue for your son. You will have to foloow protocol and call and IEP meeting. you dont have to give a reason, just request one in writing, and send a copy not only to the teacher but the head of spec ed at the school, and also hte head of spec ed at the distric/county level as well. ( it really seems to get ther attention when you CC to all 3 .. In the mean time have your MD, ped or specialist, whomever your son sees regularly write the district a to whom it may concern letter, staing the child cannot ride that period of time for medical reason, dont have to explain any more than you want to. And bring it to the meeting. Then hold your ground and have it included in the IEP. Period. Don't sign off until it is written in. They cannot make you. They can try to, and can bully you. If they refuse, write an addendum to the IEP stating you do not agree with the committee, and you are part of the committee, then take it before the school board, if they are still stubborn. It is hard to fight when your child is so young and you are thinking the district has your child's best interet at heart. YOU have your child's best interest at hear. They may or may not on any given day.
