They have to respond in writing one way or the other, or else, I believe, they are out of compliance. They have a certain number of days to respond, but I don't remember how many. Good luck. If so your daughter's school has to evaluate her within 45 days of receiving your written request. Check out your states DOE website (I googled it) and click on 'Topic Briefs'. I think the first heading is " Evaluation Procedures'. Read over this and you will find that the school must follow through within 45 days. I would attach this to your written request!
