In order to get this changed you would have to show that the aide needs to be in the classroom . . . what is happening while the aide is on lunch duty? Does the teacher require the aide during that time? Is your child being ignored, getting in trouble, etc. during the time the aide is gone? Is the teacher on your side with this issue? No . . . there is no state law that says that there needs to be a specific # of adults in the classroom at all times. The principal has the discrepancy to use staff where they are needed during the day . . . but, there is also the obligation to provide services to the children in the classroom . . . so, you have to show that the aide NEEDS to stay with the class. In my opinion . . . IF the aide is needed in the class - she is needed ALL DAY in the class and the principal SHOULD be using other staff to cover lunch time duties! Have you talked to the aide? It may work out to be a

good thing. No one really likes lunch duty, but it

may be a good mental break for her so that she can

come back in and be more for your child. Remember

that the aides don't get coffee breaks during the day.

Many of them are only allowed 20-30 minutes a day to

eat.
