Sending in 1st appeal again

Hi, I really appreciate everyone's advise.

I spoke to the complaint investigator and she said to go ahead and

send in another package. She says BCBS has to respond to her

regarding all my complaints within 30 days (one of which is that they

acknowledge receiving my package but admit they goofed and lost it).

I also spoke to my attorney who is preparing a letter to include with

this package. He says we have a basis for a suit as they, to start

off with, are in violation of our contract and he feels they have

acted in bad faith. He says we should try and avoid the headache of

a lawsuit by sending them in the 1st appeal again and see if they

approve it. We are also sending them a copy of the proof of delivery

from the original FedEx shipment.

I am sending the package to the managers attention and he assures me

they will review it and respond within a short period of time.

I will update everyone when they have responded.

This sounds fantastic. You really do have all your ducks in a row! I would definitely save yourself the headache and give them one more chance to make things right with you. Go, fight, win!
