And...every state has different law making it even more complicated. However...you are right. Generally if a party does not show up in court, a default judgment is entered against them (i.e. they lose). Then the issue becomes enforcing that judgment against them (i.e. making them pay). Jurisdiction issues (who can sue someone and where) add some loopholes, but that should only be temporary. Usually if a case fails for jurisdiction...it can be brought somewhere else depending on statutes of limitations (time one has to sue). All of these cases would not just be thrown out for good. I am going to look into this more and find out what they could be doing. There are so many legal tactics that could be responsible for this. On another note, many large companies take advantage of the fact that they can outspend most smaller parties. Delays are a great tactical approach for anyone with more time and more money. Guest guest Posted November 21, 2004 Report Share Posted November 21, 2004 I am feeling really well. I am still recovering from surgery but I actually have more energy than I did before. I know that I am not instantly cured from explantation...but I really feel a lot better. I think I will recover completely (hopefully) because I was so lucky to catch it early on. I did have my implants for seven years...but I only felt a lot of pain in the last year. And my neurological and auto-immune symptoms hit me hard about four months ago. Once I read stories of other women who were sick for years and several doctors could not figure out what I had...I started looking for a surgeon immediately. I just knew it had to be my implants because the stories I read were all exactly like mine. Luckily...I do not think the silicone damaged my system as much as it could have. Only time will tell. I really feel for women who were being poisoned for years. I cannot imagine the pain I was in...and the pain of not knowing...lasting for years. By sharing their stories...they saved my life. And, most shockingly - to not show up. Come on, why after all these years have there been no payouts or cases taken on with these women, many with stories in media magazines with black moldy implants? I had over 12 firms turn me down, just saying it would cost too much money and be next to impossible to go up against them. However, I was told, that these cases were dismissed for no show.
