The doctor and the hospital have to give you your records. We are all so vulnerable after being explanted, I know that I was. Find a friend to go with you, the pathologists report should tell you most everything that you need to know. Most pathology records are easy to obtain, just go directly to that department. Some women have their lawyers contact the plastic surgeon for their records. You could call Dr. Blais here in Canada, he might be able to give you some advice. They will get them motivated. (I work for attorneys who do this all the time, so I know!!) THEY HAVE TO GIVE THEM TO YOU. Don't leave without them and if they try to say they can't scream a little louder!!!!!! (They are all afraid of geting sued!) Guest guest Posted December 1, 2004 Report Share Posted December 1, 2004 Dear Ladies -- As for my lying PS and hospital -- they found a way around the laws -- they claim that they found my records but cannot find any of the implant ID or product insert records there. When I then asked them to send me the rest of my records for me to look through them myself-- they then said they could find where the rest of my records went. Unfortunately the law only helps when you are dealing with honest people. Since I can no longer sue for malpractice -- the statute of limitations is long passed for my surgery -- the only thing I have been told over and over is that they will not give over my records for fear of being exposed for the wrongs done in my case. I have been told that if I subpoena my records, they will be destroyed (if they have not already been) to see to it that they never reach the light of day. SOOOOO - I must use alternate means of identification for my implants. I have been told that Dr. Middleton can probably identify them via MRI. The $64,000 question then is: is that sufficient for the settlement facility? Does anyone know of anyone who ID'ed their implants successfully with an MRI -- whose MRI was considered sufficient proof of identification? I want to know this before I go to the expense of flying to San Diego for this MRI. If the MRI is not going to be acceptable proof then I must ensure that my explant/repair/possible 2nd reconstruction surgery occurs by late May or I will forgo the rupture $$$ -- and surely I have at least 1 (if not both) implant ruptured by now. Thanks for your wishes/concern that I should be able to get my medical records and I agree -- but I have sadly learned through this miserable ordeal that you cannot force those who have no conscience to be honest.
