401K withdrawls

Is anyone familiar with working with a patients 401k plan? We have a

patient who will be withdrawing from their plan to cover transplant

expenses. The handler of the plan states that there will still be the

20% tax on withdrawl, but I thought if it was a hardship withdrawl this

did not apply. Are they correct?

I just heard on the

news that if someone can prove that there is a hardship they would not have to

pay the penalty and medical issues was talked about as being a hardship.
