Guest guest
Bindu, I am not a lawyer, I have no legal training, and our situation should not be compared to yours, so consult a lawyer before making any decisions about your situation. In our situation, with my son, when the school district had an IEP meeting without me and my wife, our lawyer told us, that was a MAJOR violation of the law. He suggested we try to get evidence from that meeting, some notes from the meeting, some written decisions from the meeting, something that showed the meeting took place without us. Also, they failed to notify us in writing so many days before the meeting and THAT was a violation of the law. This placed us in a Major position of strength for negotiating what we wanted for services when we threatened to take them to Due Process. Here is a link to a good resource explaining how the ARD process should work: http://www.tea.state.tx.us/special.ed/ardguide/pdf/e-ardguide.pdf also here is a good website about Disability rights in general regarding IEP's and ARD meetings. http://www.reedmartin.com/ You need to contact someone from an ARC chapter near you. It is a volunteer org of Advocates that will go to your ARD meeting with you and help you stand up for your rights for your child. Their website is http://www.thearc.org/chaptersearch/ Good luck, J. I would appreciate it if some of you could please share your experiences and expertise with me. What is the next stage when the school rejects your proposal? Is it a hearing stage ( a stage at which we get a lawyer), what happens at this point and after that. We could not attend the IEP meeting last week and strangely the school district says that they had an IEP meeting without us. This means we were not even presented with an opportunity to explain to them or tell them about goals for our son. Has anyone else faced this kind of a situation, if so what would you advice or what would be the next stage. Also I would greatly appreciate it if you could please give me some tips based on your experiences. You could write to me in private at saiom@.... Thanks in advance, Bindu
