Time out for stim behaviors?

My son is being evaluated for some neurological problems i.e.

seisures we may not be aware of that are causing his

attention/inappropriate laughing behaviors. Anyway, we've repeatedly

informed them that they MUST adapt or modify their curriculum to

accomodate our son and they REPEATEDLY refuse to do it. My son is

having laughing behaviors which may or may not be avoidance

behaviors. At any rate, the school has not done a functional

behavioral assessment of this and we have NEVER used time out to

address his behaviors. IT DOESN'T WORK!!! He doesn't have the

language skills to ask simple WH?'s like " When can I be done? " or " I

don't understand. " or " How much longer do I have to do this? "

or " It's to hard, I can't do it. " or When can I play at centers or

about a million other things that he could be thinking but can't

verbalize. He was expected to complete the assignment like the other

kids before he could play at centers. He just stimmed. They put him

in time out and brought him back to the room and they said he

completed his assignment. Therefore their approach works and they do

that with the other kids. They want to discuss a place for time out

in the Kindergarten room. The note said they put him in his " old

time out place " in Mrs. P's room (the Pre-K teacher last year). My

husband and I are shocked. This time out place was never discussed

with us! It's news to me. Anyone have any thoughts on this?
