There is case law specific to autism and ESY which demonstrates how absolutely unreasonable it is to require regression before providing ESY services for children with autism. Basically, it states that it needs to be assumed they will regress, and that the window of opportunity for effective intervention is limited so you just can't let that happen. Of course, this is not 5th circuit case law so the districts ignore it. Until they are FORCED to do right by our kids, most Texas districts specialize in circumventing the law and our children's needs.
