" On the issue of " prerequiste skills, Jim Mulick, McEachin and I had the

pleasure of working several years ago on a matter involving a child in Utah

who was then in a mainstream preschool, supported in school by a behaviorally

trained and supervised ABA provider, with additional ABA intervention at

home.

It was quite a long saga, but in August of this year, the 10th Circuit Court

of Appeals (the level just below the U.S. Supreme Court) held that the

child's

parents were entitled to reimbursment for the ABA supports on the theory that

the mainstream preschool was THIS child's least restrictive environment, and

that she was making very nice progress in that setting BECAUSE of the ABA

supports secured at school and at home.  How refreshing it is when a court

that

important " gets it. "

will be on the Today Show in December with Couric to talk about

avoiding due process. But he'll spend a full day in Dallas Fort Worth visiting

with parents about working with their school districts.
