Guest guest Posted May 23, 2002 Report Share Posted May 23, 2002 Hi Joann, It is very hard to get ESY for children unfortunatly. But it has been done. The hardest part is to prove to them that your son will regress. I knew this before my son would start the transition into school. He just turned 3 yesterday and I had every 1 of his Therapist who worked with him which by the way was not in the same state (we just moved) and his evals. They all requested summer survices and some kind of program for him. Only 1 therapist who worked with him las year, who did not service him for 2 weeks noticed a slight regression in his behavior and so in her report said that If Jack goes more than 2 weeks without services he will regress! So maybe that is what did the trick for us, just having it written. I don't know the age of your son or how long he has been in public school but did he receive services last year? I just have spoken to so many parents who's children were far more deserving of summer services that Jack had a really tough time getting them. And now this is the first summer out of EI and JAck will be attending a intergrated pre-school summer program and receive therapy. Maybe my situation is different, just a thought. I don't want my daughters to go to summer school because I want them to be on our swim team. The IEP team [Mom, you are an important member of the IEP team] makes the decision for this service. Review progress reports and prior evaluations to help make the decision to provide services during the summer vacation period. If the district is not providing ESY (extended school year), you as the parent, must receive WRITTEN NOTICE [an explanation as to why the service is denied... the reason for denial should not be because of " Staff Vacations. Private therapy (paid for by the school district) may need to be considered. Guest guest Posted May 28, 2002 Report Share Posted May 28, 2002 ESY was a fight for my daughter this year but since I knew it would be I intentionally documented and talked to her case manager after Christmas break and Spring Break (2 weeks long) to tell them/get documented that she HAD regressed over those breaks. Currently she's soaring developmentally BUT she regressed in articulation pretty badly and so they are giving her summer services because of that. This sounds like a farce to me to deny your child services because the slp's are on vacation. If that is their only excuse and your child qualifies it sounds like you have grounds to file due process to me (although you didn't elaborate too much)...anyway if you phoned the advocacy group there (and if you don't know of one I may be able to track it down for you) you could talk to an attorney (free) for advice and possibly they could act on your behalf. It really depends on what your particular school district is REQUIRED to do but here if your child NEEDS the service and QUALIFIES for it they CANNOT deny your child or they are in BIG BIG trouble.
