<PRE>they are very strange how they decide all of this. i was on short term

disability from work. i was out about 10 months. they told me i was giving up

and i was too young. so i went to my dr. we set some restrictions and asked

for a adjustable desk and i went back to work for about 6 weeks before i ran

out of sick and vacation time again. i went back on short term disability,

but it was a separate case and i had to wait another 51 weeks before being

considered for long term benefits. about 3 mos later i was approved for

social secuity disability. i let my company know. they said it would not

effect my short term disability and i should just send them the paperwork now

instead of digging it out in 6 months when they would be looking into my ltd

benefits. 5 months later they decided i was not disabled. i sent my appeal

letter in and they called me and told me that since i am no longer disabled

they can let me know that my job was eliminated back in feb, so they would be

sending my severence package. doesn't it figure. i am still waiting for their

decision on my appeal for disability. they say i got it so soon. i agree, it

took 6 mos. but doesn't that mean i am sick? they used to pay my $3000/mo

treatments. what changed that they forgot to tell me about?? they make me

feel like i bought the judge. so now my family is helping me pay the almost

$500/mo cobra fees, while waiting for june and my medicare to begin. good

luck with your battle. kathy in il

Hi

I was approved threw th state for Disabilty, they paid up to the two years when

this all began, and then one month after, they thought I would beable to work

with the mtx, they figured that it was helping me and then decided to pay me up

to the point that I tried to go back to work, it only lasted a short time, now

I've been without for two months.I don't know what i could do to help speed up

the process, I don't want to wait for months on and on

Jane,

Maybe you should call an attorney, who deals with social security. He may

be able to speed the process up. Also, you could call your Congressman, if they

can help they will.

Carol,

I am so sorry you were turned down. Geez...what does it take!

I have never gone through the

SSDI process, and there does not seem to be much consistency for folks from this

group...except that very often people were turned down the first time and

succeeded the next time...so take heart in that.

Do you have an attorney very experienced with disability presenting your case?

It seems like that might be a good investment at this point, if not.

I am glad you have been checking in even though I realize how difficult it is

for you to write.

Take Care, Cam

Carol, I went through the process of applying for and finally being awarded with it. It was 3 years from my initial turn down until my hearing / award. As I understand it, unless you are terminally ill, everyone gets turned down the first time. Then you do the appeal and most people get turned down that time as well (but not all, as some else in this forum, sorry, cannot recall her name at the present, won on her appeal (2nd try I think it was) or I could be mistaken.

Anyway, you can get an attorney to help you after you've been turned down the first time. The attorney only gets paid if you win, and the $$ comes out of your back pay, not to exceed $4,000.00. Back pay being based on the date SSDI determines your disability date, mine was based on the last day I worked.

Also, if you have a doctor supporting your disability claim that helps a LOT in the 2nd go round. I didn't - no one knew what my condition was (not many flat back/post HR experts in my area), so by the hearing date I had had my revision surgery, a diagnosis but no support from my ortho, but my family physician was supportive and instrumental.

I was awarded in February of this year (or March). I don't know if having the attorney helped, but I wouldn't try it again without one. They know so much more about the whole process, they won't take your case unless they think you can win, and like I said, they get a percentage of your backpay but not to exceed $4,000.00 and if/when you get your lump sum (backpay) from the government, that amount will have already been deducted and paid to the attorney.

I had short term/long term disability benefits through my job (thank goodness I took that out - EVERYONE, do that if you haven't already but wait until open enrollment, like the once a year when they re-up your benefits.

When my short term turned into long term disabilty (6 months, I think), my carrier, once they reviewed and approved the ltd, did so with me having to sign an agreement that I would file for Social Sec. disability and also recommended a firm that handled a lot of their cases. This firm was located somewhere in the mid-west so I signed on with them. Their involvement came in when my hearing date was set. I cannot recall off hand if they were only to help out after the second rejecton ....it was all a 3 yr. process and I just don't recall the details right off hand.

All along SSDI has been saying that they've been trying to get caught up on processing claims so if you have to go to hearing hopefully it won't take so long - and I do recommend (my own personal opinion) getting an attorney. They can answer so many questions, from everything I've read, more people who have attorneys win their cases and in many cases you won't have to show up at the hearing - but the attorney keeps you very well informed.

And, even though my attorney was so far away, she met with us the day of the hearing, after being in steady contact with me once my hearing was set. She had 3 clients in my area to represent in her two day stay. She, along with other attorneys, fly to wherever the hearing is all them - that's what they do.

They might even be able to advise you on the student loan forgiveness issue.

I was turned down for the Soc Sec Disability yesterday. I will appeal. I'm sure the Revision surgery and brain tumor, or Aphasia will help my case. (?) Luckilly I still have the disability retirement from my work.Does the student loan forgiveness is hard to get? I applied for the loan forgiveness I haven't heard from loan people yet.(my daughter's student loan)(communicate since the Aphasia makes it hard)Carol Vaughandcvaughansbcglobal (DOT) net

Carol,

Do you have a lawyer helping your SSDI case? If not, I would suggest that you

find one to help with your appeal. I would think that you should be approved

with relatively little difficulties, considering your medical history. I'm

sorry to hear that you're dealing with aphasia. That would be really difficult.

I haven't heard how hard it is to have student loan forgiveness for a parent

loan. I know that it took a lot of time & patience for my student loans to be

forgiven. It took over a year of paperwork, phone calls, and follow-ups. Now

it has been about 16 months since my loans were forgiven and I am in a dispute

over the amount paid. It is very frustrating, but I know that I can't give up

or else " they " win by default.

I hope everything is going well for you.
