You must treat them like a direct client, and send a legally binding contract plus ask for 40% at least upfront, and without telling them this strategy, get paid the balance before sending the last 2 files (or parts of project). I am telling you this from bad experiences with the USA, and that is not the only country. Getting paid by agencies or direct clients is always difficult for us. I hope this helps somewhat.
