In order to qualify, you have to demonstrate that your liver disease is causing a day to day inability to work. The people who are found disabled due to liver disease, including hepatitis and cirrhosis, are very, very ill. Symptoms are hard to prove. For instance- pain. My lawyer went to the judge and told him, " you honor, my client has terrible significant chronic pain. Now , I know this court sees this complaint often, but not often does it see the same patient being treated by a pain doctor, and with opioid medications, which are not freely given out, I argue that his symptom of pain is more credible than someone who would report pain as a symptom, but yet receive no treatment for it. " In a case like Sharon's, she has a provable condition, and three surgeries to try to fix it, but on her application we were focused on HOW it affects her. HOW it makes her not able to work. HOW she is dizzy all the time. Her application can be summed up like this- 1-I've got one continuous HEADACHE since 2002, which has not gone away, 2-I'm nauseated 3-I'm dizzy 4-my joints hurt 5-I can't stay awake in the daytime, 6-I can't sleep at night. 7-I can't remember words and even things, times, people, and places, 8-I my hands hurt period. it does mention her medical condition, but does not focus on it. He condition looks like this- Ehlers Danlose syndrome, Chiari malformation, Basilar impression, platybasia, retroflexed odontoid, scolioisis, tethered cord syndrome [postural-orthostatic-tachycardia-syndrome(not complete diagnosis yet)] The SSA will not know what all that means, and will not care. They want to know what is causing this woman to not be able to work. --------------------------------------------------------------------------------\ --------------------------------------------------------------------------------\ ----------- My case looked like this= I have liver disease which causes me chronic pain, nausea, shortness of breath, mental confusion, day-night reversal, fatigue, exhaustion. And to aswer your specific question, yes , cirrhosis is a terminal illness as defined by the SSA and will expedite your case, says my attorney. Good luck. Guest guest Posted December 15, 2008 Report Share Posted December 15, 2008 thank you bobby yes it helps,we went to the hep dr. today bobby glen goes to a nuerologist as soon as they call us with an appt. hes concerned with his dizzy spells and what his job consists of working of ladders, he said we will need this to apply for disability which he suggests, he is contacting the dr. at vandy to see how to proceed with treatment ,he too doesnt understand the illect drug crap, we need to find a pain dr. in our area also he will be referring us i guess, bobby glenn will have a scope for bleeds and an ultra sound on friday, he was concerned with b.g. waiting so long to come back to him but understood the going back and forth with doing anything as aposed to doing nothing.he says b.g will need a new liver no questions asked, he also said the hep. treatment could decompensate him so there for hes consulting with the vandy dr. as to that also. its all so hard to understand. but at leasdt we are moving forward again ,till b.g changes his mind again. he was explaining to the dr. how the med. bills are piling up and hes laid off right now, so hopefully he will help us with the disability ins. phew its alot to remember so tonight i start my book,i am not sure how to make one except to right everything down every dr. says. again thank you so much ,much love barby > > > > > > Thank you all for your many prayers. Guest guest Posted December 16, 2008 Report Share Posted December 16, 2008 will do bobby, i know it seems like we tell the dr. something and the next appt. he acts like its the first he heard of it, thats why i taped the vandy dr. but the hep. dr wont let me so i am gonna have to write down eveything we say in the appts? so thats why bobby glens side is hurting ,his spleen?i think the ultra sound is for that, ok i am just gonna say it, I DO NOT KNOW WHAT THE HELL I AM DOING, OR HOW TO DO IT, i need help with how to keep records i remember someone saying the kept a book diane sandi i cant remember. i know to take all his tests to every appt. but i know bobby glenn felt odd yesterday reading his list of aches pains complications off to the dr. ,the dr. had a strange look on his face but every time i would try and explain it he would just look back at b.g and ask him another question.his memory has gotten bad so we wrote it all down but it came of as rehearsed and cry babish once we was in there. ok i am fretting for no reason ,the appt. went better than the others and i cant wait to see about the bleeds and the ultra sound, he will go to the urologist on jan 22, unless they have a cancelation ,then we can go earlier.he will get vaccinated next week for hep a and b were as he has markers for both.after all that we will do what ever they do to check for liver cancer ,he will have to do this every 6 months huh.ok rambling any advise will be appreciated as it always is. phewwwww what would i do without my peeps!!!much love babry > > > > > > > > Thank you all for your many prayers. I have a division for Daily Meds, Test Results, Progress Notes, Medical History and Medical Contact Numbers. You can add or leave off any division you need. Under Daily Meds I keep a current listing of all Terry's medications and the dosages. Under Test Results I keep copies of all test results. In this division you may have to keep sub-divisions for differing tests. For example, I have the major division Test Results, with sub-divisions for Liver, Kidney, Labs, Spleen, Brain, Digestive or Abdominal, etc. You get the gist of it. Under Medical History I keep everything I know about any medical history such as previous surgeries, previous illnesses, diseases he is at risk for due to family history (as well as which family member had that disease), anything about his medical history. Under Medical Contact Numbers I keep a listing of all his doctors and their contact numbers as well as to whom in their office I usually speak. Also, all hospital where he has been an inpatient or has had outpatient procedures as well as medical equipment providers such as the company who provides his leg brace, his CPAP equipment, etc. Now, under Progress Notes, I keep a typed documentary of all office visits, telephone calls with doctors offices, any contact with any medical office that can document what was said and by whom. I take notes at all appointments and then come home and type everything into the computer and keep the records there. I print and update Healthcare Notebook as often as necessary. Sometimes that is more than once weekly, depending on what goes on in any given week. I take the book with us everywhere we go cause you never know when he might get sick and you'll need your notes. If I can help you in any way, just let me know. It's not hard to do, but it can be time consuming but it is so worth it when you need it. I was approved for disability in 1998. I have to get 'updated' every couple of years. Terry's accident was in Apr, 2000. My 'update' was due and I got my letter to come in. I called them and explained that my husband had just been in a terrible accident and was in the Trauma Intensive Care Unit and I didn't need to leave him. They told me I HAD to keep my appointment or I would lose my SSDI! I asked if I couldn't reschedule and they flat told me NO. So, I had to leave the hospital and drive home ( a two hour trip, one way) so I could sit in that idiot's office for literally 25 minutes, then turn around and drive back to the hospital. I called my Congressman, my Senators, everybody I could think of to complain. Guest guest Posted December 17, 2008 Report Share Posted December 17, 2008 sure bobby ,he is being scoped for varicies friday, no bleeds yet, his belly is huge with the veins showing,he has bad swelling in legs feet hands,trouble sleeping,headaches,gets to shaking /trembling at times,sick to his stomache,itching to the point his arms look like they will bleed, bruises and bleeds badly,muscle soreness/pain,quick temptered at times down right ugly,pain in his side and upper stomache area,shortness of breath even when lieing down,cramping in legs and hands,memory terrable as well as eye sight,dizziness and unsteady on his feet at times,i have all this complide where as we worked on his med. log book for hours last night, (i am pretty proud of my work:),and glad we will have it with us on fri. ,still need to get dr. notes from family dr. .hey can i ask for dr. notes from hep. dr and vandy dr.?will they give them to me? is it our right to have them? oh and he has high blood pressure too, takes med. for it thats what started this whole mess the b.p. and swelling .also his concentation is as short as one of the grandkids now, says he has CRS disease (cant remember sh**)lol. ok thats what we are dealing with. love barby > > > > > > > > > > Thank you all for your many prayers. IT IS ABSLOLUTLY THE LAW. You have the legal right to all of those medical records. I was approved almost 3 yrs ago at 38. Yes he got 25 % of my back pay, but my claim was back dated 2 1/2 years to when my symptoms first caused me to not be able to work full time. So when I got my approval, I had already had the 2 year wait ,on paper, for Medicare....so I had it right off the bat. That in itself has been a lifesaver with my medical bills.. When I got my SSDI, I was supposed to pay the lawyer from my lump sum, but he decided he didn't want it after all, so I only had to pay for paper work, about $70. That was the first thing they asked us when Momma had to go on dialysis. So, if your kidneys are not functioning fully, that is an indication the liver is not functioning or functioning at a very low level. The problem is that they didnt pay my lawyer as was agreed to when we went to court. We later found out only after she wrote to congress to copmplain, they paid her fee to ME. Sharon and I turned in an application for a waiver of this over payment. I hope they grant it, or we are going to have to fork over 3,000 to the federal govt. The good thing is that our lawyer said she would write us a check for then 3,000 if we end up having to pay it. She yelled at my congressman in an angry letter and told him that we cant afford to pay a 3000 overpayment. We received the money in good faith and spent it to live because Sharon lost her income in June 08. I hope this will all be settled ok. This is exactly what my judge meant when he ruled that I have an organic mental disorder, and cognition and memory problems. I don't remember reading a letter that said they had not received the proper paper work to take the lawyers fee out at time of award,( she did in fact turn in the proper paper work) and so it is up to me to pay her. Beware of this pitfall. My onset date was Jan4, 2007. BUT they didnt give me any credit for any of Jan, because of the 5 month wait before you are eligible. My true onset date therefor is NOT jan4, but in reality, FEB 1st. Yes he got 25 % of my back pay, but my claim was back dated 2 1/2 years to when my symptoms first caused me to not be able to work full time. So when I got my approval, I had already had the 2 year wait ,on paper, for Medicare.... so I had it right off the bat. That in itself has been a lifesaver with my medical bills.. In order to qualify, you have to demonstrate that your liver disease is causing a day to day inability to work. Now , I know this court sees this complaint often, but not often does it see the same patient being treated by a pain doctor, and with opioid medications, which are not freely given out, I argue that his symptom of pain is more credible than someone who would report pain as a symptom, but yet receive no treatment for it. " In a case like Sharon's, she has a provable condition, and three surgeries to try to fix it, but on her application we were focused on HOW it affects her. HOW it makes her not able to work. HOW she is dizzy all the time. Her application can be summed up like this- 1-I've got one continuous HEADACHE since 2002, which has not gone away, 2-I'm nauseated 3-I'm dizzy 4-my joints hurt 5-I can't stay awake in the daytime, 6-I can't sleep at night. 7-I can't remember words and even things, times, people, and places, 8-I my hands hurt period. it does mention her medical condition, but does not focus on it. He condition looks like this- Ehlers Danlose syndrome, Chiari malformation, Basilar impression, platybasia, retroflexed odontoid, scolioisis, tethered cord syndrome [postural-orthostat ic-tachycardia- syndrome( not complete diagnosis yet)] The SSA will not know what all that means, and will not care. They want to know what is causing this woman to not be able to work. ------------ --------- --------- --------- --------- --------- - My case looked like this= I have liver disease which causes me chronic pain, nausea, shortness of breath, mental confusion, day-night reversal, fatigue, exhaustion. And to aswer your specific question, yes , cirrhosis is a terminal illness as defined by the SSA and will expedite your case, says my attorney. Good luck.
