Hi, Barby. This is what I know about Social Security Disability. You can get

this even if you are not retirement age. In order to qualify, you have to

demonstrate that your liver disease is causing a day to day inability to work.

The government's own criteria is so strict, that to qualify by your lab tests,

you would be dead. here are those numbers-

http://www.thedisabilityexpert.com/Liver%20Disease%20and%20Applications%20for%20\

Social%20Security%20and%20Supplemental%20Security%20Income%20Disability%20Benefi\

The

Social Security Administration evaluates all chronic liver disease the

same way whether it is caused by cirrhosis, hepatitis, or some other

cause. Liver disease including hepatitis and cirrhosis is a common

reason for applying for Social Security and/or Supplemental Security

Income disability benefits. Many of these cases are denied. The

people who are found disabled due to liver disease, including hepatitis

and cirrhosis, are very, very ill. There are a number of ways that a

person with chronic liver disease including hepatitis and cirrhosis can

be found disabled.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver

If a person with chronic liver disease, including hepatitis or cirrhosis,

has a history of a massive hemorrhage due to esophageal varices, then the

person will be considered disabled for 3 years after the last massive

hemorrhage. After the 3 years are over, the person's Social Security and/or

Supplemental Security Income disability case will be reviewed to see if the

person is still disabled.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver

A person with chronic liver disease, including hepatitis and

cirrhosis, will considered disabled for 3 years after a shunt operation

for esophageal varices. After the 3 years are over, the person's

Social Security and/or Supplemental Security Income disability case

will be reviewed to see if the person is still disabled.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver,

liver

A person with chronic liver disease, including hepatitis and

cirrhosis, will be found disabled if he or she has a serum bilirubin of

2.5 mg. per deciliter or greater persisting for at least 5 months upon

repeated examination.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver

A person with chronic liver disease, including hepatitis and cirrhosis,

will be found disabled if he or she has ascites, not attributable to other

causes, demonstrated by abdominal paracentesis or associated with persistent

hypoablbuminemia of 3.0 gm per deciliter or less.

liver, liver, liver, liver, liver, liver liver, liver, liver, liver, liver,

liver

If a person with chronic liver disease, including hepatitis and cirrhosis,

has hepatic encephalopathy; then the resulting mental limitations are evaluated

under the Social Security Administration¢s regulations for evaluating mental

conditions.

liver, hepatitis, cirrhosis, liver, hepatitis, hepatitis, cirrhosis

A person with chronic liver disease, including hepatitis and cirrrhosis,

will be found disabled if his or her chronic liver disease is confirmed by

liver biopsy and the person has at least one of the following:

· Ascites not attributable to other causes, recurrent or persisting for

at least 3 months, demonstrated by abdominal paracentesis or associated with

persistent hypoalbuminemia of 3.0 gm. per deciliter (100 ml.) or less

· Serum bilirubin of 2.5 mg. per deciliter (100 ml.) or greater on

repeated examinations for at least 3 months

· Hepatic cell necrosis or inflammation, persisting for at least 3

months, documented by repeated abnormalities of prothrombin time and enzymes

indicative of hepatic dysfunction BUT- You can be found to EQUAL these

criteria, or even be found disabaled without any of them, if you have a needle

biopsy, and SYMPTOMS. Symptoms are hard to prove. For instance- pain. My

lawyer went to the judge and told him, " you honor, my client has terrible

significant chronic pain. Now , I know this court sees this complaint often, but

not often does it see the same patient being treated by a pain doctor, and with

opioid medications, which are not freely given out, I argue that his symptom of

pain is more credible than someone who would report pain as a symptom, but yet

receive no treatment for it. "

In a case like Sharon's, she has a provable condition, and three surgeries to

try to fix it, but on her application we were focused on HOW it affects her. HOW

it makes her not able to work. HOW she is dizzy all the time. Her application

can be summed up like this-

1-I've got one continuous HEADACHE since 2002, which has not gone away,

2-I'm nauseated

3-I'm dizzy

4-my joints hurt

5-I can't stay awake in the daytime,

6-I can't sleep at night.

7-I can't remember words and even things, times, people, and places,

8-I my hands hurt

period.

it does mention her medical condition, but does not focus on it. He condition

looks like this-

Ehlers Danlose syndrome, Chiari malformation, Basilar impression, platybasia,

retroflexed odontoid, scolioisis, tethered cord syndrome

[postural-orthostatic-tachycardia-syndrome(not complete diagnosis yet)]

The SSA will not know what all that means, and will not care. They want to know

what is causing this woman to not be able to work.

--------------------------------------------------------------------------------\

--------------------------------------------------------------------------------\

-----------

My case looked like this=

I have liver disease which causes me chronic pain, nausea, shortness of breath,

mental confusion, day-night reversal,

fatigue, exhaustion.

And to aswer your specific question, yes , cirrhosis is a terminal illness as

defined by the SSA and will expedite your case, says my attorney.

Good luck. Love, Bobby

life, old age, everything good-Apache prayer

hey bobby this caught my eye, what do you mean ?you got your

disability faster because of the cirrhosis or because you had a

laywer? bobby glenn really wants to get his started but we are not

sure how to live while we wait, plus i went to the site and i dont

think his #s are bad enough yet to sign up.he goes to the dr. for the

hep. today to see about treatment again ,were as hes been off the

meds. hopefully he can get started but i am here to tell you the poor

guy suffers alot some days more than others.hes been laid off till

after the first of the yr. when work picks back up so he thinks now

is the time while he has umeployment coming in. hopefully the dr. can

help advise us today too, but truthfully i trust you more than him

thank you bobby yes it helps,we went to the hep dr. today bobby glen

goes to a nuerologist as soon as they call us with an appt. hes

concerned with his dizzy spells and what his job consists of working

of ladders, he said we will need this to apply for disability which

he suggests, he is contacting the dr. at vandy to see how to proceed

with treatment ,he too doesnt understand the illect drug crap, we

need to find a pain dr. in our area also he will be referring us i

guess, bobby glenn will have a scope for bleeds and an ultra sound on

friday, he was concerned with b.g. waiting so long to come back to

him but understood the going back and forth with doing anything as

aposed to doing nothing.he says b.g will need a new liver no

questions asked, he also said the hep. treatment could decompensate

him so there for hes consulting with the vandy dr. as to that also.

its all so hard to understand. but at leasdt we are moving forward

again ,till b.g changes his mind again. he was explaining to the dr.

how the med. bills are piling up and hes laid off right now, so

hopefully he will help us with the disability ins. phew its alot to

remember so tonight i start my book,i am not sure how to make one

except to right everything down every dr. says. again thank you so

much ,much love barby

You, my dear, are going to be just fine!  Nothing motivates a woman like going

to battle for her man or her family.  You hang in there girl, life may knock us

down every now and again, but it can't keep us down!  I love you and I'm always

here for you.  Praying that you will never lose that awsome spirit and drive to

survive!

Love and hugs..........

Barby, I keep a notebook with divisions in it.  I have a division for Daily

Meds, Test Results, Progress Notes, Medical History and Medical Contact

Numbers.  You can add or leave off any division you need.  Under Daily Meds I

keep a current listing of all Terry's medications and the dosages.  Under Test

Results I keep copies of all test results.  In this division you may have to

keep sub-divisions for differing tests.  For example, I have the major division

Test Results, with sub-divisions for Liver, Kidney, Labs, Spleen,  Brain,

Digestive or Abdominal, etc.  You get the gist of it.  Under Medical History I

keep everything I know about any medical history such as previous surgeries,

previous illnesses, diseases he is at risk for due to family history (as well as

which family member had that disease), anything about his medical history.

Under Medical Contact Numbers I keep a listing of all his doctors and their

contact numbers as well as to

whom in their office I usually speak.  Also, all hospital where he has been an

inpatient or has had outpatient procedures as well as medical equipment

providers such as the company who provides his leg brace, his CPAP equipment,

etc.  Now, under Progress Notes, I keep a typed documentary of all office

visits, telephone calls with doctors offices, any contact with any medical

office that can document what was said and by whom.  I take notes at all

appointments and then come home and type everything into the computer and keep

the records there.  I print and update Healthcare Notebook as often as

necessary.  Sometimes that is more than once weekly, depending on what goes on

in any given week.  I take the book with us everywhere we go cause you never

know when he might get sick and you'll need your notes.  If I can help you in

any way, just let me know.  It's not hard to do, but it can be time consuming

but it is so worth it when you need it.  Any

questions, call me at and we'll talk or just email me and we'll

work it out.

Luv ya!

Diane

Thanks Barby!  I can't even remember his name after all these years.  I'll tell

you one better than that though.  I was approved for disability in 1998.  I have

to get 'updated' every couple of years.  Terry's accident was in Apr, 2000.  My

'update' was due and I got my letter to come in.  I called them and explained

that my husband had just been in a terrible accident and was in the Trauma

Intensive Care Unit and I didn't need to leave him.  They told me I HAD to keep

my appointment or I would lose my SSDI!  I asked if I couldn't reschedule and

they flat told me NO.  So, I had to leave the hospital and drive home ( a two

hour trip, one way) so I could sit in that idiot's office for literally 25

minutes, then turn around and drive back to the hospital.  I called my

Congressman, my Senators, everybody I could think of to complain.  Of course it

did no good, but it made me feel better!

Barby, can you give me /us a short review as to what symptoms he has had, and

what complications? Has he had bleeding varicies? This is very very important.

THanks. B

Sent via BlackBerry from T-Mobile

Re: disability claim-how to

will do bobby, i know it seems like we tell the dr. something and the

next appt. he acts like its the first he heard of it, thats why i

taped the vandy dr. but the hep. dr wont let me so i am gonna have to

write down eveything we say in the appts? so thats why bobby glens

side is hurting ,his spleen?i think the ultra sound is for that, ok i

am just gonna say it, I DO NOT KNOW WHAT THE HELL I AM DOING, OR HOW

TO DO IT, i need help with how to keep records i remember someone

saying the kept a book diane sandi i cant remember. i know to take

all his tests to every appt. but i know bobby glenn felt odd

yesterday reading his list of aches pains complications off to the

dr. ,the dr. had a strange look on his face but every time i would

try and explain it he would just look back at b.g and ask him another

question.his memory has gotten bad so we wrote it all down but it

came of as rehearsed and cry babish once we was in there. ok i am

fretting for no reason ,the appt. went better than the others and i

cant wait to see about the bleeds and the ultra sound, he will go to

the urologist on jan 22, unless they have a cancelation ,then we can

go earlier.he will get vaccinated next week for hep a and b were as

he has markers for both.after all that we will do what ever they do

to check for liver cancer ,he will have to do this every 6 months

huh.ok rambling any advise will be appreciated as it always is.

Barby, I am so proud of you!  You have your stuff together and are on the ball!

I am so sorry to hear about Bobby Glen's symptoms.  Everything you describe is

all too familiar to me.  As far as the doctor's notes, yes you have a right to

have copies of them.  You may have to make the call and explain what you want

and then just let them talk to Bobby Glen to give consent.  Or, you may have to

go by and let him sign some release forms, but you can get the records.  You

hang in there girl, you're doing great!

Love and hugs........

Diane

Hi, Barby. This is what I know about Social Security Disability. You can get

this even if you are not retirement age. In order to qualify, you have to

demonstrate that your liver disease is causing a day to day inability to work.

The government's own criteria is so strict, that to qualify by your lab

tests, you would be dead. here are those numbers-

http://www.thedisabilityexpert.com/Liver%20Disease%20and%20Applications%20for%20\

If a person with chronic liver disease, including hepatitis or cirrhosis,

has a history of a massive hemorrhage due to esophageal varices, then the

person will be considered disabled for 3 years after the last massive

hemorrhage. After the 3 years are over, the person's Social Security

and/or Supplemental Security Income disability case will be reviewed to see if

the person is still disabled.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver

A person with chronic liver disease, including hepatitis and cirrhosis,

will be found disabled if he or she has ascites, not attributable to other

causes, demonstrated by abdominal paracentesis or associated with persistent

hypoablbuminemia of 3.0 gm per deciliter or less.

liver, liver, liver, liver, liver, liver liver, liver, liver, liver, liver,

liver

If a person with chronic liver disease, including hepatitis and

cirrhosis, has hepatic encephalopathy; then the resulting mental limitations

are evaluated under the Social Security Administration¢s regulations for

evaluating mental conditions.

liver, hepatitis, cirrhosis, liver, hepatitis, hepatitis, cirrhosis

A person with chronic liver disease, including hepatitis and cirrrhosis,

will be found disabled if his or her chronic liver disease is confirmed by

liver biopsy and the person has at least one of the following:

· Ascites not attributable to other causes, recurrent or persisting

for at least 3 months, demonstrated by abdominal paracentesis or associated

with persistent hypoalbuminemia of 3.0 gm. per deciliter (100 ml.) or less

In a case like Sharon's, she has a provable condition, and three surgeries

to try to fix it, but on her application we were focused on HOW it affects her.

HOW it makes her not able to work. HOW she is dizzy all the time. Her

application can be summed up like this-

1-I've got one continuous HEADACHE since 2002, which has not gone away,

2-I'm nauseated

3-I'm dizzy

4-my joints hurt

5-I can't stay awake in the daytime,

6-I can't sleep at night.

7-I can't remember words and even things, times, people, and places,

8-I my hands hurt

period.

it does mention her medical condition, but does not focus on it. He condition

looks like this-

Ehlers Danlose syndrome, Chiari malformation, Basilar impression, platybasia,

retroflexed odontoid, scolioisis, tethered cord syndrome

[postural-orthostatic-tachycardia-syndrome(not complete diagnosis yet)]

The SSA will not know what all that means, and will not care. They want to know

what is causing this woman to not be able to work.

--------------------------------------------------------------------------------\

--------------------------------------------------------------------------------\

-----------

My case looked like this=

I have liver disease which causes me chronic pain, nausea, shortness of breath,

mental confusion, day-night reversal,

fatigue, exhaustion.

And to aswer your specific question, yes , cirrhosis is a terminal illness as

defined by the SSA and will expedite your case, says my attorney.

Good luck. Love, Bobby

Lyncia, you shouldnt have any problems being approved for social security

disability,do as Bobby suggested and make sure you and them document

everything, and all of your symptoms. I was approved almost 3 yrs ago at 38. I

did go ahead and get a lawyer right away whom makes an agreement with you to get

25% of the back pay check, they will reimburse you from the date you applied.

good luck & god bless,

When I got my  Social Security disability, I went through a lawyer that

specialized in disability claims.( because I was denied the first time trying to

do it on my own). Yes he got 25 % of my back pay, but my claim was back dated 2

1/2 years to when my symptoms first caused me to not be able to work full time.

So when I got my approval, I had already had the 2 year wait ,on paper, for

Medicare....so I had it right off the bat. That in itself has been a lifesaver

with my medical bills..

I wanted to make a little comment because this reminded me of

something. When I got my SSDI, I was supposed to pay the lawyer from

my lump sum, but he decided he didn't want it after all, so I only

had to pay for paper work, about $70. He was a great lawyer who

specialized in people with Hepatitis C. He's in Chicago.

I don't mean to butt in here, but kidney disease is pretty much the ONE thing

that GUARANTEES approval for SSDI.  That was the first thing they asked us when

Momma had to go on dialysis.  They get you on SSDI so Medicare can cover your

dialysis expenses if you don't already have health insurance.

Hi, Barby. This is what I know about Social Security Disability. You can get

this even if you are not retirement age. In order to qualify, you have to

demonstrate that your liver disease is causing a day to day inability to work.

The government's own criteria is so strict, that to qualify by your lab

tests, you would be dead. here are those numbers-

http://www.thedisab ilityexpert. com/Liver% 20Disease% 20and%20Applicat

If a person with chronic liver disease, including hepatitis or cirrhosis,

has a history of a massive hemorrhage due to esophageal varices, then the

person will be considered disabled for 3 years after the last massive

hemorrhage. After the 3 years are over, the person's Social Security

and/or Supplemental Security Income disability case will be reviewed to see if

the person is still disabled.

liver, liver, liver, liver, liver, liver, liver, liver, liver, liver, liver

A person with chronic liver disease, including hepatitis and cirrhosis,

will be found disabled if he or she has ascites, not attributable to other

causes, demonstrated by abdominal paracentesis or associated with persistent

hypoablbuminemia of 3.0 gm per deciliter or less.

liver, liver, liver, liver, liver, liver liver, liver, liver, liver, liver,

liver

If a person with chronic liver disease, including hepatitis and

cirrhosis, has hepatic encephalopathy; then the resulting mental limitations

are evaluated under the Social Security Administration¢ s regulations for

evaluating mental conditions.

liver, hepatitis, cirrhosis, liver, hepatitis, hepatitis, cirrhosis

A person with chronic liver disease, including hepatitis and cirrrhosis,

will be found disabled if his or her chronic liver disease is confirmed by

liver biopsy and the person has at least one of the following:

· Ascites not attributable to other causes, recurrent or persisting

for at least 3 months, demonstrated by abdominal paracentesis or associated

with persistent hypoalbuminemia of 3.0 gm. per deciliter (100 ml.) or less

And loss of kidney function is an indication of the progress of the

cirrhosis also. So, if your kidneys are not functioning fully, that is an

indication the liver is not functioning or functioning at a very low level.

cirrhosis, has hepatic encephalopathy; then the resulting mental limitations

are evaluated under the Social Security Administration¢ s regulations for

evaluating mental conditions.

liver, hepatitis, cirrhosis, liver, hepatitis, hepatitis, cirrhosis

A person with chronic liver disease, including hepatitis and cirrrhosis,

will be found disabled if his or her chronic liver disease is confirmed by

liver biopsy and the person has at least one of the following:

· Ascites not attributable to other causes, recurrent or persisting

for at least 3 months, demonstrated by abdominal paracentesis or associated

with persistent hypoalbuminemia of 3.0 gm. per deciliter (100 ml.) or less

In a case like Sharon's, she has a provable condition, and three surgeries

to try to fix it, but on her application we were focused on HOW it affects her.

HOW it makes her not able to work. HOW she is dizzy all the time. Her

application can be summed up like this-

1-I've got one continuous HEADACHE since 2002, which has not gone away,

2-I'm nauseated

3-I'm dizzy

4-my joints hurt

5-I can't stay awake in the daytime,

6-I can't sleep at night.

7-I can't remember words and even things, times, people, and places,

8-I my hands hurt

period.

it does mention her medical condition, but does not focus on it. He condition

looks like this-

Ehlers Danlose syndrome, Chiari malformation, Basilar impression, platybasia,

retroflexed odontoid, scolioisis, tethered cord syndrome

[postural-orthostat ic-tachycardia- syndrome( not complete diagnosis yet)]

The SSA will not know what all that means, and will not care. They want to know

what is causing this woman to not be able to work.

------------ --------- --------- --------- --------- --------- -

My case looked like this=

I have liver disease which causes me chronic pain, nausea, shortness of breath,

mental confusion, day-night reversal,

fatigue, exhaustion.

And to aswer your specific question, yes , cirrhosis is a terminal illness as

defined by the SSA and will expedite your case, says my attorney.

Good luck. Love, Bobby

I also recieved backpay when I was approved. The problem is that they didnt pay

my lawyer as was agreed to when we went to court. We later found out only after

she wrote to congress to copmplain, they paid her fee to ME. Sharon and I turned

in an application for a waiver of this over payment. I hope they grant it, or we

are going to have to fork over 3,000 to the federal govt. The good thing is that

our lawyer said she would write us a check for then 3,000 if we end up having to

pay it. She yelled at my congressman in an angry letter and told him that we

cant afford to pay a 3000 overpayment. We received the money in good faith and

spent it to live because Sharon lost her income in June 08. I hope this will all

be settled ok. This is exactly what my judge meant when he ruled that I have an

organic mental disorder, and cognition and memory problems. I don't remember

reading a letter that said they had not received the proper paper work to take

the lawyers

fee out at time of award,( she did in fact turn in the proper paper work) and

so it is up to me to pay her. Beware of this pitfall. My onset date was Jan4,

2007. BUT they didnt give me any credit for any of Jan, because of the 5 month

wait before you are eligible. My true onset date therefor is NOT jan4, but in

reality, FEB 1st. Stupid butt head SSA.

Subject: Re: Re: disability claim-how to

When I got my Social Security disability, I went through a lawyer that

specialized in disability claims.( because I was denied the first time trying to

do it on my own). Yes he got 25 % of my back pay, but my claim was back dated 2

1/2 years to when my symptoms first caused me to not be able to work full time.

So when I got my approval, I had already had the 2 year wait ,on paper, for

Medicare.... so I had it right off the bat. That in itself has been a lifesaver

with my medical bills..

If a person with chronic liver disease, including hepatitis or cirrhosis,

has a history of a massive hemorrhage due to esophageal varices, then the

person will be considered disabled for 3 years after the last massive

hemorrhage. After the 3 years are over, the person's Social Security

and/or Supplemental Security Income disability case will be reviewed to see if

the person is still disabled.

A person with chronic liver disease, including hepatitis and

A person with chronic liver disease, including hepatitis and

repeated examination.

A person with chronic liver disease, including hepatitis and cirrhosis,
