If you want your school to pay for another evaluation, you have

to disagree with their evaluation and ask for an “Independent Educational

Evaluation at public expense”. Use those exact words as they have

legal significance straight from the federal special ed law (IDEA).

Independent Educational Evaluation

(IEE)

An

evaluation conducted by a qualified examiner who is not employed by the LEA

responsible for the education of the child being evaluated. A parent has a

right to request an IEE at public expense when the parent disagrees with an evaluation

conducted or obtained by the LEA. When the parent asks for an IEE, the LEA must

give the parent its evaluation criteria and where to get an IEE. The criteria

must include the qualifications of the examiner and the location of the

evaluation.

The IEE must meet the same criteria the LEA uses for its own evaluations. The

LEA does not have to pay for the IEE if it can show at a due process hearing

that the LEA's evaluation is appropriate or if it can show that the IEE does

not meet the LEA's criteria. The parent always has the right to get an IEE at

the parent's expense. Regardless of who pays for it, the ARD committee must

consider any IEE that meets its criteria.

my son has been evaluated by the supposed

Autism Team and he said

that he was manipulative. That is why i requested another eval. I

cannot and will not allow them to get their way this time. He does

hold his bowel movements until he gets home. Now, if he has to go he

will not go or say anything to them so that is what causes part of

the acting out. I have told them this aleady and they still dont

want to believe it. Also, he doesnt eat anything at school. When i

ask them about what he ate they say 'he ate, he ate his yogurt'. Im

sick and tired of the school not listening to what im saying. I am

prepared to go to the superintendent now and if that doesnt work. I

will take my case to the school board members. ENOUGH IS ENOUGH!!
