Latest update, my neurologist office called today and I was told that " he doesn't do disibility " . (I sent him the Medical Source Statement to fill out). Can a physican actually refuse to fill out this form? Also, I was told that the best he could do was offer me a functional eval. Any thoughts on this matter? Guest guest Posted March 6, 2007 Report Share Posted March 6, 2007 Ok. I just thought it wouldn't be that big of a deal for him to fill out the medical source statement concerning employment. Light work and sustained work. It didn't ask anywhere on the form if he felt that I was disabled. What a grueling process!!! I have looked a few times on the Web for a description of the functional eval. Anywhere this can be found? What I have heard of it, it exhausts me to even think of trying to do some of the things. Anyway, I am getting scared about the whole process. It is stressing me out! And yes you have posted a lot of helpful info. I hope that I have my all ducks in a row. I am a single mom of a 9 yr old boy and take better care of him than his healthy father could only dream about taking care of him. Hope this makes you feel better. Guest guest Posted August 6, 2007 Report Share Posted August 6, 2007 Hi Nuvee, The best advice I can give you is 1) get a lawyer and 2) print off everything you know of on CMT and educate your lawyer about what you CAN DO with CMT, and obviously for 8 years, like you said, you have raised your children well to this point. (Make a list of how you have cared for the kids -- laundry, meals, clothing, education, medical and health care, and more) I don't believe this is " discrimination " per se as based on the ADA, sounds like your ex is just attempting to make this a dirty custody battle. Guest guest Posted August 6, 2007 Report Share Posted August 6, 2007 Hi , Thanks for replying.My son went to live with him less then a yrs last yr and the cop was called twice due to domestic violence between him and his son.My son is getting older and he needed his dad and that is the only reason I let him try living with his father.My attorney think we may have a good case but is all still up to the judge.So wish me Luck. She used the opportunity to ask for increased child support payments. The judge didn't grant his claim, but gave her more support money, and made him pay for the court costs. Went to court for a custody hearing and the judge talked to the child in his champers...alone! The child was only ten...and the Judge listened to his wishes...hurray. Good Luck.
