So if you get doctor that had no idea what CMT is chances are your child will be denied SSI. We also consider the income and resources of family members living in the child's household. These rules apply if your child lives at home. They also apply if he or she is away at school but returns home from time to time and is subject to your control. If your child's income and resources, or the income and resources of family members living in the child's household, are more than the amount allowed, we will deny the child's application for SSI payments. However, we consider certain medical conditions so limiting that we expect any one of them to disable a child. In these cases, we make SSI payments right away and for up to six months while the state agency decides if your child is disabled. Following are some of those conditions: HIV infection Total blindness Total deafness Cerebral palsy Down syndrome Muscular dystrophy Severe mental retardation (child age 7 or older) Birth weight below two pounds, 10 ounces If your child has one of the limiting conditions that is expected to disable a child, he or she will get SSI payments right away. However, the state agency may finally decide that your child’s disability is not severe enough for SSI. If that happens, you will not have to pay back the SSI payments that your child got. and CMT falls under the MD so they shouldnt of denied it right? .. Guest guest Posted July 11, 2007 Report Share Posted July 11, 2007 J Hart, OK, immediately file a Request for Reconsideration focusing on 1) the severity of your child and 2) the financial need of the family. And keep a copy for your files. Send new medical/doctor info for your child too that focuses on " severity " . SSA compares info with the IRS when it comes to finances. Look on the denial letter you got, it may also give you more information that was 'missing' from your original application. It may be a good idea to take your child in to the SSA office when you file your Request, and it may be something to think about now, getting an attorney, if your family resources DO support your SSI claim. Guest guest Posted July 11, 2007 Report Share Posted July 11, 2007 No, CMT does not " fall under " MD at all with the SSA. CMT is not MD. IF your child had a diagnosis of MD, then that child would be eligible to receive immediate payments while the process goes on. I just posted the Blue Book listings for children, read over that and tailor your Request based on the severity of symptoms that your child has. Guest guest Posted July 12, 2007 Report Share Posted July 12, 2007 I began receiving SSI in 1983 before my daughter was born. I was approved with no problems at all and my doctor didn't know squat about CMT. I learned about 3 years ago that I had to file for SS on my father's claim or I lose my SSI completely.
