In NY, “welfare” is not called welfare and you apply at Social Services which is a state run agency. Social Security is federal. I’m nervous and was hoping someone who’s lived through it can give me a couple of tips. I am basing my claim on rheumatoid arthritis, peripheral neuropathy and I’m throwing in HCV, cryoglobulenemia, herniated discs, Reynaud’s and glaucoma for good measure. If I don’t get it on this first go-round, I don’t know if I can afford to support myself for the length of time it will take for an appeal so it’s now or never! I e-mailed the paralegal I’ve been working with to let her know the exam was done this morning and that I wasn’t confident that I’d be approved. She replied that it’s common to be denied and to have to appeal – the wait to go before the judge is approx. 18 months. Looks like I’ll be registering with a temp agency. I guess there are different ways of filling out the forms, but I don’t know that I’d be better off with a different attorney. At this point, all they do is file the application. What do you believe one attorney can do that another might not? I sure hope that I luck out like your husband and mine goes through as well. I’m hoping that there is more weight placed on what my doctors say in their reports than what this doctor says. I have a copy of my neurologist’s report and he states, “Totally and permanently disabled” so you can’t be more clear than that. This attorney was recommended by my neurologist and has represented many of his patients. He assured me that they have a high success rate and I truly don’t believe that any of the attorneys take cases that they don’t feel have a good chance of winning. I took my neurologist’s recommendation for an attorney because he deals with this on an ongoing basis and I’d be doing little more than picking someone out of the phonebook. I do hold to not all fighting as hard for you, but whatever.. It really does matter what forms are filed, and when.. Sure glad you are satisfied with the attorney that you have, half the battle. I’m not being misled into thinking that I could have a resolution to an appeal in a few months. I’m actually not dissatisfied nor am I satisfied. It’s just the way it is. Guest guest Posted June 30, 2008 Report Share Posted June 30, 2008 Dorothy, I can speak from experience about this because had I NOT made that appointment with our local attorney who ONLY specializes in ssdi cases, I would have gone to that mandated/ordered appointment to that doc who works for the state and she might have not agree'd with my docs and that could have cost me my continued ssdi. As I said, an attorney who specializes in only ssdi knows all the rules and how the system works. The case worker who was re-evaluating my case was threatening me if I didnt go, and had I not gone to that attorney, I probably would have been intimidated by her and would have gone and as I said, it 'could' have been disasterous for me financially.. This attorney also told me about the law that no one else told me that if I turned 50 years old while being on ssdi and they re-evaluated me , that they could NOT force me to EVER take a desk job unless I had worked at a desk job previously, which I had not.. So there are little things that an attorney who does not specialize in ssdi might not know or may not remember etc,, so I believe that its very important that you see one who specializes in ssdi.. and you can't take everything the paralegal says as truth either.. It would be nice if our justice system was really fair for everyone, but unfortunately we have now grown a special group of justices and judges who think they can change the rules from the bench... so anything is possible and what we thought was a sure bet before no longer is... My last employer had it all set up with Alsup as a paid benefit for those who needed to switch from company long term disability to the federal SSDI program. Alsup refused to let me give up, they kept appealing my case and they actually went to the hearing with the judge on my behalf, I didnt even have to appear.. they gathered all the info needed and made sure that the paperwork was done properly with all the t's crossed and all the i's dotted so to speak.. But with my final approval, the judge wanted to reevaluate me in 18 months and thats when I went to see this attorney in this town we now live in... the state was going to send me over an hours drive in a car to see their doc.. He is the one who really helped me to stand up for myself and demand that THEY FOLLOW the LAW and stop harrassing me..I surely hope you get yours the first time,, I really do.. I wouldnt wish that kind of harrassment and frustration on anyone hon..IM keeping my fingers crossed for you!Jackie Interesting.
