The issue really isn't so simple here. While yes, she should be in jail for at least manslaughter, they picked the wrong set of charges that could lead to precedent problems. Part of the issue is how much power does a license agreement actually hold? As a techie, this case throws me into a conundrum. Perhaps inciting violence might have been a better charge, or perhaps manslaughter?

One basis of written law is that if it's not there, then the government can't step in.
