Do not lose hope people--this was a defeat, but the battle is far from over. Our Autism Omnibus Cases are not effected by HR 5710 in any way and parents will still be able to proceed to civil court if they opt out or their claims are denied by Special Master Hastings at the conclusion of the VICP case. That is just " Phase 1 " so to speak. The unfair 3 year limitations issue still needs to be resolved and, here is the plan for that issue--we need to start pushing the Burton/Waxman Bill (HR 3741) now and keep the pressure on. We will be working on this over the weekend in DC. I'm heading back this Thursday. HR 3741 will be re-introduced when the 108th reconvenes in January!!!! The glass is half full, not half empty. Our cases will be fine. Also, Yep, Vote me if I run for the US House again!!! Just kidding (well, not really). More to follow--We're not going away. Here are the Homeland Security advocates standing up now on the floor of the senate, and saying [ON THE RECORD] that these thimerosal- related cases will have their opportunity through the VICP, and then if not satisfied, will be able to proceed on to the courts. It seems to me like the door may crack open a bit sometime in the not-too- distant future, for the case to be made to suspend the statute of limitations for any claim that would fall under the Autism Omnibus Proceeding.
