FYI, I am hereby attaching copy of " Bill of Rights of Persons who are

Developmentally Disabled " FS 393.13, as well as the complete index of FS

393 with web page link information.

As member of the FCCs, as we began a new legislative session, and we look

at the new DD Service Directory, the Prior Service (Maximus) justification,

and the issue of " medical necessity " , I believe that we need to pay more

attention to this statue, and its intent.

393.13 (3)(d)(7) reads: " It is the intent of the Legislature: ... To

provide programs for the proper habilitation and treatment of persons with

developmental disabilities which shall include, but not be limited to,

comprehensive medical/dental care, education, recreation, specialized

therapies, training, social services, transportation, guardianship, family

care programs, day services, and habilitative and rehabilitative services

suited to the needs of the individual regardless of age, degree of

disability, or handicapping condition. No person with developmental

disabilities shall be deprived of these enumerated services by reason of

inability to pay. "

In looking at the DDPO web page at:

http://www5.myflorida.com/cf_web/myflorida2/healthhuman/ddp/publications/

index.html, I noticed that the " Bill of Rights of Persons who are

Developmentally Disabled " (FS 393.13) is not available. Would it be

possible for the same to be added to your web page. I do not believe that

we are paying the attention that we need to pay to such Bill. I also think

that we need to amend that name for one using " people first " language.
