You need to get a hold of the IDEA Law. It states

policies and procedures. Where do you live?

If you go to www.yellowpagesforkids.com and put in your state you will get a

bunch of information on advocates that can help you with your situation.

I know how frustrating this is. I have been in those situations when Tim was

young. The school needs to understand that your son has special needs and

perhaps you can impliment a plan in his IEP that will help him understand his

behavior.

When Tim was in high school we finally got a plan where if he did something

inappropriate he would go to the princepal and they would discuss his behavior.

IE:

What were others doing around you?

How did that make you feel?

What did you do?

What are some other ways you could have handled this?

What will you do if it happens again?

These simple questions allowed Tim to understand his behavior and take

responsibility for his behavior. Within months his behaviors totally changed

because he was able to talk about it and understand why it wasn't a good

solution to the problem and what other things he could do instead.

As bright of a young man as Tim is, he often had trouble understanding

consequences for his actions. Most kids think " If I do this...I will get into

trouble " But Tim never seemed to think about what would happen after he did

something.

Obviously Tim's behaviors were mainly a self defense from others who picked on

him or egged him on to do things he shouldn't.

Now-a-days a lot of schools are taking a zero tolerance policy when

it comes to fights and threats. EVEN if the child does not know what

they are saying is wrong. You have got to remember that after

Columbine, schools are not the same. The schools MUST treat all

threats the same. If they excuse one child then the others will

say, " Why did I get suspended and they did not? " My oldest son was

suspended for two days (out of school) for saying to a friend that he

was going to kick his ass. It was said as a joke but the school said

that it had a zero tolerance policy and since another person

overheard the comment, he has to be suspended.

I know that this is not what you wanted to hear, but if we want our

children treated as everyone else, then, we must take the good with

the bad. I was one who always said, " Tyler does not know what that

means, " or thing like that. The thing way, I was excusing Tyler's

behavior and not correcting it. Now, even if I think that Tyler does

not know what he said, he does get in trouble and I tell him why it

is bad.

I would check with the school and see if they have a zero tolerance

policy.

Find out who he learned the comments from. I had that problem with my now 20

year old (well similar school-induced problems) and that is when I decided to

homeschool my others. mass schooling is not for me.

Does your son have an IEP? How many days did they suspend him? Is there a

pattern of similar behavior, or is this an isolated incident? The school can

suspend a student with an IEP, but if he is suspended more than 10 days, they

have to conduct a manifestation determination hearing. That means they have to

determine whether the behavior in question was caused by his disability. If it

was not caused by his disability, they can go ahead and suspend him without

services if they deem it necessary. If the behavior was caused by the

disability, they can still suspend him, but they have to provide services.

Up until IDEA was renewed this past year, the behavior only had to be related to

the child's disability. With the new law, though, it must be caused by the

disability in order to be determined to be a manifestation of the disability.

Since I do not know all the details of your son's situation, I can only give you

this general answer. However, you may want to contact an advocate who can give

you better advice specific to your son.

thank you for your feed back>. I have been struggling a long time with the fact

I want my kid to be treated and accepted as equals with his peers, but I also

think he needs some special treatment because of his abilities.

It was just one day and I believe we have resolved the issue with the school,
