Owners of 11 units at Avian Forest sued Heritage Litchfield Inc., Heritage Communities Inc. and Build Star Corp., saying the mold happened because rain got into the firewalls between the units while they were under construction. The companies, all part of Heritage Communities Inc., disagreed with the extent of the mold infestation and whether the owners could sue over it because it was in a common area of the buildings. The circuit court found in favor of the unit owners, and the company appealed. The Appeals Court's ruling on Monday could be appealed further to the state Supreme Court.
