Disability hearing

Yea!! I have been denied for disability 2x now, and I have appealed

again. Well, apparently this persistence has paid off. I just received

a letter this week saying that I have a hearing in the next town to see

if I qualify. I will be allowed to see what evidence they have only 30

min before the hearing. My question is, what documents do I need to

have with me when I go? I have several from past doctor visits, plus I

have a list of all my medications. Would it be a good idea for me to

list the medications and what they are taken for? Any advice would

surely be appreciated.

hi kellie you tell them about you meds how thay make you feel and you will have

to take them the rest of your life and if thay make you on cloud 9 tell them

tell them how it efects your life this is your chance to tell them give them

both barrows tell them how it has changed your life donnieKY

hey Kellie, where do you live. I have been waiting seems forever and I have

finally got my hearing for Feb. 10 I live in Ga. Jena

Hi Kellie, I am sorry I missed your original post. but like I said in my earlier

post. I go on Feb. 10. I hired a lawyer. but everyone has told me to take

everything. write every little thing that you cannot not do that you use to do.

how your disability effects your life. EVERY TINY LITTLE DETAIL. if you have

trouble tying your shoes or anything no matter how small it may seem to you it

is something you need to do on a daily basis. one of my biggy's if the fibro

fog. I cant remember anything. the harder I try the more screwed up I get. it

makes me sooooo mad. How long you can sit, stand , lay...etc.... all these

things are important. I did not go near into enough details on my first 2

applications.

didn't mean to butt in. but I learned the hard way. that is way I hired a

lawyer. one of the mail reasons if you may tell me something and 5 minutes later

it is gone from my mind.... and this has nothing to do with all my back

injuries.

hope this helps. Jena in Ga. There are also places you can go to read if you

can soak up what you ready. it is something like www.ssi.gov

Hope you have a lower pain level and get some rest. also there are sites that

people have done to help you with your disability. just plain people. I will

look and see if I can find them.

hi kellie i hope things go good for you i know it is hard waiting i went throw

the same thing tell them how the pain pills make you feal funny if thay do tell

them tell them everthing you tell them will help you need all the help you can

Don't you have a disability advocate or one of those disability lawyers?

They should have all of those papers. Mine did. I never had to present one

piece of paper. She had it all together and the judge had it before I even went

into the room. If anything new popped up I got a copy and dragged it into my

advocate to add to her files on me. Any and everything.

She presented the case and he had the paperwork already.

As far as paperwork goes...anything and everything that shows whats going on

with you. They even looked back further then anything my advocate had..to a

doctor I had forgotten about but had been seen for my back in it's earlier

injury.

Go back as far as you can that is important about why you are seeking

disability. ER visits, if any, would be good as well as all your visits and

diagnosis. This documentation is probably more important then anything you can

say...do both. If your documentation tells how it's impaired your life that

really helps.

I hope with all my heart all goes well for you. It's very scary and the wait

for " Big Letter " is crazy. I NEVER want to go thru all of that again. If you

are not using a disability advocate and do not win this case...go again with an

advocate. It's very difficult on your own. Just don't give up.

Cloud 9??? Oh, man!! Where? I'm on stuff any party hardy druggie would kill

me for...but where's cloud 9? Somehow pain gets in the way of that. I'm just

grateful to walk. Functioning is my cloud 9 I guess. Don't know if cloud 9

would be good thing or not...I dunno. It just hurts.;-}

Hey Lotacats, I go 2-10 for my hearing. I do have a lawyer. he and his firm has

a very good name and will not take a case if they do not think you will win. and

if you don't win they get nothing. I am terrified. and of course since I first

applied this last Nov. two years ago. my conditions have slowly and gradually

worsened. I don't have a clue what to expect. I am suppose to go and meet with

my lawyer and he will go over everything I am suppose to do at the hearing. I go

in January about a month apart. heck I will be forgotten. that is one of my

biggest problems, I can't remember anything. I have to write down everything and

still mess it up most of the time. :(

Wonderful that you have your advocate/lawyer.

You're right about " if they don't think they can win they will not take it " .

Same with me. I would have paid nothing if we lost. As it was, we had a ceiling

of $4000...once that hit we pay nothing more then that no matter how long it

drags on. She got her $4000 in cold cash.

Man...she liked that so well she gave us back a couple of hundred to go out to

dinner on.

It was the best $4000 I EVER spent. We (my sons and I) got all that back

pay....the first thing was get the cash...open an account in a bank and set up

an automatic deposit for the monthly payments. Best thing you can do. Safer.

I took my kids to Vegas to just have fun at with the star trek display and so

on. They were such good support. We went thru it together.

Then set up an apartment, furniture and so on with all that back pay...and here

I am today.

I can appreciate the scared. So was I. I had to keep getting my advocates

supportive touch over and over. She said she was used to it. It is soooo

scary.

After the hearing it was about six months to know what happened...that letter

that says... " FULLY FAVORABLE " seems to take forever. I walked back upstairs

with that thick envelope in my hand shaking like a leaf. I was terrified to

open it. After two years and I was terrified. I sat there with it in my lap

just shaking. My son was going... " Well...open it...open it! " . Yes...I know

what you mean.

All you can do is hang tight, hold our hands and wait...that is the hardest of

all. My condition has continued to worsen as well....hang tight.

I just know you'll be ok. I understand what you are going thru right to the

bottom of your feet to the top of your head.

You will win this!!...my judge was a great big grouch....and I won. I wish I

could wave a magic wand and make you feel better...but...no wand.

That's what to expect. You do the hearing...and you wait. The longest wait in

your life.

I was messing up so bad...I forgot what I was saying...and the judge, in his

grouchiness, kinda grouched at me and I froze...and said .. " I don't know what

you want me to say " ...I just froze...I caught a small grin he made turning his

head. He scared the crap out me..but I won. So...you can as well.

I looked so unrehearsed I HAD to be telling the truth. They know. Talk about a

deer in the headlights. They want to hear concise...to the point...not some

long story. Just the truth without a lot of " stuff " . Good luck. I will be

with you in spirit holding your hand.

I had my hearing on 11-26-08 and I got my fully favorable letter by

12-12-08. I am still waiting to get the letter telling me what my

benefits will be and how much my back pay will be. They owe my three

years back pay. I know how hard it is to actually open that letter. I

was shaking so badly that I could bearly hold on to it. I hope I get

some money soon though because I am going through a very bad time

financially right now. I have never needed money more then now.

Hey Beth, I don't guess it really matters but I was just wondering what state

you live in. actually in Ga where I live the hearings have been really slow. I

have been told Ala. was twice as fast as Ga. Just to know that you do have it

coming has got to be a relief. my Mama had her in her bank acct, a couple of

weeks and didn't even know it.
