I read something about these problems, in the Air Traffic towers, over a year ago. Same old story over and over but nothing ever gets done. When they finally get around to doing some thing it will be too late for many. It was also disclosed at that time, that at least 15-16 other Air Traffic Control Towers were experiencing similar unhealthy conditions environmentally (e.g., Chicago O'Hare International, Denver, San , etc.) . I have documentation in my office substantiating every bit of what I am conveying. What is happening to conceal unhealthy environmental conditions across the United States (especially with pathogenic mold exposures) is deplorable. Not only are mold exposures literally " pushed under the rug " as merely allergens and causing nothing more than allergies and perhaps asthma, but even as far more difficult serious in hospital patients to medically diagnose and treat, the diseases they cause are not classified as " unreportable illnesses " by the CDC. In fact, one former highly placed medical researcher Ruth Etzel, M.D, PhD, who resigned from the CDC, stated in a July 26, 2000 WebMD interview that, " ... the CDC has sought to bury the connection between mold and disease. " (Source: http://www.ehw.org/Healthy_House/HH_Toxic_Mold.htm) What is happening here is not simply with the Air Traffic Controllers as it is also observed with the victims of hurricane Katrina, in medical offices with untrained and uncertified medical doctors who misdiagnose fungal diseases, and in the lack of responsible government in investigating and establishing legislation to properly inform and protect American citizens. To provide an example of this, California was the first state to sign into law in 2001, SB-732 (Ortiz) " Toxic Mold Protection Act " , and AB-284 () " Mold Research, Education and Training " . One would think that this was responsible government at work. However, what people do not know is that these two bills were never funded, research was never done, and both bills remain " dormant " on the books of law in California. In other words, just like everything else, when the dust clears and the the controversy dies down laws that were written to protect go into a dormant and useless file somewhere, until government needs to recall them for its own preservation. Another example of this is that recently the FDA was provided with more power to monitor and regulate tobacco makers. The trouble is, the FDA has had this power all along, aside from political browbeating and constraints, they perhaps could have done more in the way of preventive education over the past century. However, what people to not know is that even though more than 22,000,000 Americans have died (averaging 430,000 per year) since the Surgeon General's politicized " warning " was placed on packages of cigarettes in 1964, research has shown that not only is there deadly consequences in " second-hand " tobacco smoke and smoking during pregnancy, but that there are over 42 different species of very unhealthy mycotoxin-excreting molds in the tobacco product known to cause cancer or birth defects. " Has there never been any task force formed at all within the Dept. of Health as designated per SB-732? Clearly finding and establishing acceptable levels of molds has never been dealt with for obvious reasons. However, aren't there aspects of SB-732 consisting of Article 4 Disclosure, sec. 26140- 26153 that have been implemented in Ca. regarding mold disclosure that affect homeowners and renters? Though the disclosure laws are filled with loopholes it has still been of some value to those that purchase new homes and find serious mold problems. On the other hand it appears that the disclosure laws as per SB-732, Article 4 pertaining to rentals is being twisted into what I find to be a very distressing trend. Brand new large apartment complexes are including in their leases disclosure waivers to the Prop 65 chemicals as well as molds. The waiver releases the management/owners from any responsibility saying that these chemicals as well as molds are present in their buildings and they are not responsible for any harm incurred due to exposure or otherwise. I wonder what the full legal implications are for tenants with these waivers and how well this would stand up in a court of law? I believe that if we are not vigilant that where we are headed as a society with the increasing amount of mold growth and associated problems are the eventual " waivers " that would include automatic disclosures for mold in almost all structures. The justification being that mold growth is a problem taking place in every building. B.
