Guest guest Posted September 14, 2007 Report Share Posted September 14, 2007 I have been here in Dallas Tx for almost two years in treatment for mycotoxicosis. I was feeling quite well for awhile but it would come and go. However, after moving to another hotel room here I started to decline and ended up with a kidney infection last week and urinating blood. After blood work was done and it showed kideny problems, liver problems, high WBC and neutrohpils,(I could go on but..) I inspected my ac unit in my hotel room and it was FULL of mold. I have tested it and taken pictures, and as of last night have moved across the street to another hotel. My question is, do I have a legal case here in your opinion or should I not waste what energy I have left to fight with them? I had spent $25,000.00 for that moldy room and all the mananger could say was " sorry " and they charged my account again before I left. I have spend over $100,000.00 here on medical care and would like to make them responsible for some of that as I am now back in treatment and my health is declining. I repect everyones opinion here. I did not know if I would have a chance with such a large and well known company. Keep records with dates and details along with the photos and find a good attorney. LOL on that! My toxic, waterbound apartment killed my husband and left me with a severe case of toxic encephalopathy. I can no longer drive or live independently. I am so debilitated and was unable to procure an attorney although I tried and tried. One attorney even sent a mold inspector over and he found that our home was highly contaminated. Then, for some reason, the attorney backed out. My physician claimed that mold related illness was " just a bunch of hype " . Now, too much time has passed. Between being so ill and having to take care of the details of my husband's final arrangements, I just gave up. If you have a GOOD attorney, you should have a strong case. Best of luck to you! As an educational gesture only, and not as an attorney (which I am not-- so you might consult one) the normal procedure for determination of case filing is that " you are aware that you were harmed by another. " In establishing a timeline for this, it is normally " when you knew that you had been harmed, or should have known. " The " when you should have known " seems to be the preferred code that attorneys attempt to play upon. However, one suggestion before you start, and that is all it is, not a recommendation or any legal advice (because I cannot give you any), some folks have had marginal success in hiring an attorney for the purpose of simply sending a " Letter of Demand " before filing any legal matter.
