September 9, 2007 -- KAITY Tong is homeless and possibly penniless

after mold enveloped her Chelsea apartment in July, forcing her and

her husband to seek refuge in a hotel.

" As wonderful as the Gramercy Park Hotel is, it isn't home, " the

CW11 news anchor told The Post's Braden Keil. " I want to go home,

but only when it's back to the way it was. "

Tong's and hubby Callahan's nightmare began more than seven

weeks ago when a large wall section and flooring began to buckle in

their penthouse apartment, most likely from construction in an

adjoining building. " There were never any leaks or problems in

Kaity's apartment until work began next door, " said her lawyer,

Wagner.

Tong's apartment - which is still registering dangerous levels of

toxins, according to the testing company retained by her legal

eagle - is next door to the venerable O'Neill Building on Sixth

Avenue, which is being converted to condos costing up to $8 million.

Wagner says the apartment directly below Tong's has also experienced

major flooding and that Elad Properties, developer of the O'Neill

and also the behind-schedule Plaza, has " been in there several times

to do repairs. "

When Tong complained to Elad about mold and water damage, the

company originally agreed in a letter to pay for her $600-a-night

lodgings and to repair the damage to the wall that borders the

O'Neill. But Tong has already ponied up at least $10,000 of her own

money toward the hotel bill, which totals more than $31,000 before

taxes.

" They haven't paid us a penny, " said Wagner. " Now [Elad] is saying

they don't want to pay any more than 27 days, and Kaity has already

been there for 49 days. And she's probably going to have to remain

there a few weeks longer. "

He says the apartment remains uninhabitable - and Tong and Callahan

still don't know where the moisture is coming from.

" She will be totally and completely reimbursed, " Elad spokesman

Lloyd Kaplan insisted. " It's not about money. We want to fix the

problem. A leak came from somewhere, but we're not sure whether it

even came from our side. "

Kaplan says a " third party " may be needed to resolve the situation.
