Watertown town clerk wins mold dispute lawsuit

December 11, 2007 WATERBURY, Conn.—A Superior Court judge has

ruled that Watertown wrongfully terminated the town clerk's salary last year in

a dispute over medical problems and mold.

The judge says Town Clerk Virginia is owed more than a year of back pay.

had sued the town, claiming she was working in an unsafe environment in

the Town Hall because of mold.

went on medical leave in February 2006. She claimed the 113-year-old

Town Hall has widespread mold problems because of water damage and that's

causing her health problems.

The town cut off her pay, but the judge says is an elected official, not

a regular employee and as such her salary must be paid regardless if she

performs her duties.

I want to know what the difference is: now if this was a regular employee no

pay, but since it is an elected official they get paid. Does this Judge

recognize mold illness for an elected official but wouldn't for the regular

employee? Darlene

I'm not sure the judge recognizes mold illness at all--just that the

official had to be paid. Even if it wasn't a mold victory, at least it

was a victory.
