Dear Colleagues,

Greetings! Three months of grueling preparation paid off

handsomely as the Texas Medical Board took one crushing

blow after another from the questions of the legislators on

the committee and from the testimonies from the physicians

and others at the October 23, 2007 House Appropriations

Subcommittee on Regulatory Hearing. This hearing was

convened to investigate the abuse of power by the Texas

Medical Board. It was a marathon session lasting 11-1/2

hours. Without this hearing we would not have been able to

expose the corruption at the TMB. We all owe a debt of

gratitude to Representative Fred Brown who, by holding this

hearing, demonstrated indomitable courage and determination

in the face of extreme political pressure to abandon it.

The hearing made it clear that there is an unholy cabal

made up of Don , Executive Director, Mari ,

Director of Litigation and Enforcement, and a

Kalafut, President of the TMB, who have despoiled the TMB.

There can be no reform without removing them from the

board.

.. It would be worthwhile to listen to the testimony of at

least some of the doctors and patients who testified. Their

testimony was compelling.

Board member Tim : " ... I do think there are a

couple of problems, based on the things I've seen and

things I've heard here today .... I do have some bad vibes

about some things that to me were confirmed today .... "

The Goals of the Texans for Patients' and Physician's

Rights (www.txppr.org) continue to be the following:

The elimination of the following: 1) anonymous complaints,

especially from insurance companies, hospitals,

pharmaceutical companies, attorneys, competitors, and fired

or disgruntled employees 2) anonymous " expert " witnesses,

3) Star Chamber proceedings held in secret, 4) prohibition

of notes and recordings in hearings, 5) denial of due

process to physicians, 6) discipline for menial and trivial

records' findings, 7) intimidation tactics, 8) manipulation

of assignments to the Informal Settlement Conference (ISC)

panels rather than a fair system of random assignments, 9)

forced settlements, and 10) conflicts of interest of the

TMB members.

We are advocating: 1) the sacredness of the patient/doctor

relationship, 2) transparency of charges and proceedings,

3) accountability of TMB members for their actions and the

removal of blanket immunity for members of the TMB, 4)

integrity of the board members in carrying out their

responsibilities, and 5) the acceptance of and giving equal

weight to evaluations of a physician's care by physicians

other than those chosen as so called expert witnesses by

the TMB.

We are also recommending that the Texas Legislature

establish an independent, public Texas Medical Board

Oversight Committee, the members of which would be

appointed by the Texas Legislature, to ensure that that the

above legislative changes are enacted by the TMB. This

committee would report its findings to the Texas

Legislature. This committee would also receive and evaluate

complaints from patients and physicians who feel that the

TMB has acted unjustly.

Finally, there can be no true reform of the Texas Medical

Board without the removal of the current leadership. Don

, Executive Director, Mari , Director of

Enforcement, and a Kalafut, President of the TMB,

must be removed from office.

The next correspondence, which I will send you either later

today or on Monday. will deliver the knock out punch to

a Kalafut. The investigative work which has been done

on Kalafut will curl your toes and outrage you.

With much appreciation for your stand for liberty and your

opposition to tyranny, I remain, as always,

This is a great day! Those of who were all involved should be very proud of

themselves for their diligence and courage to bring this kind of injustice to

light.
