If not, and she is already in the nursing home, and whatever assets she has are spent down to the allowable amout, then she probably will have to sell her house before she could go on Medicaid. In other words, all her assets have to be pretty much gone before you can get any help. I don't think the way the taxes are paid would affect anything, unless I'm not understanding your comment about them. As far as talking to the attorney, I would ask about which assets should be spent first and how far down do they have to be spent before she can get help. I would guess that selling the house would be the last resort, unless the upkeep is more than you want to do. Also, you can spend down by prearranging her funeral and burial plot and paying for them, spend down for repairs on her home if they are needed, but the money can't be given to any children/ grandchildren, etc. If you have time to get the Medicaid regulations before you go to see him, that might help you in asking questions or clarifying issues you have. I'm not sure what state you are in, but you can access Medicaid regulations on the Internet. It probably would be helpful if you have all the figures about her assets; i.e., IRAs, annuities, life insurance, checking and savings accounts, house value, outstanding debts, and any other financial information that is relevant. Does anyone have a DPOA on her? If not, they will probably suggest that. I had saved your message and done't even know if I answered it at the time. But hope you got some good advice from your attorney. POA Type Questions I do have a question about her being on private pay now in the NH, we are paying her real estate taxes out of her accounts, but that is a a frozen rate and a senior discount. I am afraid that we need to come forward and possibly sell the house now. Does anyone know? I hear that using her IRA money is best to draw down 1st and that NH fees are considered medical expenses - any other thoughts on this? Any information site that I can refer to?
