HELP!! Judge says No heat , 4 Toxic Molds Wife 3yr old Son , dog & i SICK!!!

NEWJERSEY 2003/// Well my wife,dog,cat and i moved in a house about

4yrs ago everything was fine we move in a home were the owners were

killed in a car crash the house wasnt lived in for 2 yrs , we go in

aug 2003 Everything we are doing great about sept 2003 we get like a

16 yr old foster / Host home/ kid She was having family problems

ect, But she loves living with us and we love having her .. The house

needs work but the rent is cheap and we love it .. My wife & i have

tried to have a baby about 8 yrs now and no luck well by 2-2004 she

is PG WOW We are going to have a baby !! well the foster kid wanted

to move back to her moms house, ok let me speed it up some here we

have a healthy baby boy 10/7/04 . heis a great son but cant take

milk , he was doing great we all were , people comming all the time

partys before and after he was born . the home was bank owned the

people the house was left to lost it , the bank is are new

landlord ,they try and get us out over & over but we have a lease and

are rent is paid for the year . well the bank sells it to a man that

lives a few houses away , turns out he Architect and owns a large

company with many Architects , and he flips homes all over the

county , so we meet are new landlord , he says he isnt are landlord

wants us out .9/2005 but sends us a new lease tring to raise the rent

like $950.00 more a month, well we go to court and the judge raises

the rent $950.00 more a moth even tho we are in a lease term. well

around 10- 2005 the heat stops working in the house , landlord says

to us he wont fix the heat and he wants us out i tell him there are

laws and we have a young son we have to have heat , he still said no

heat im not going to fix it , so i tell him im going to call the

health dept his reply is good they will condem the house and then you

will be out ,i call his laywer and tell them she says you are not

tenants so you dont get heat. So we call the health dept tell her

everything no heat we are using space heaters and the heat dosnt work

at all , so she wanted the landlords name address and phone #s and we

will be getting a call back asap . so about i guess 30 mins later we

get a call back , the lady at the health dept tells us she did talk

to the landlord about the heat but they dont do single famly homes

and this is a landlord tenant problem NOT MINE . i asked her what we

should do we have a young baby , She said us the space heaters /12/06

landlord mails letter wants his plummer to come to house to see why

heat isnt working , we let him come in his plummer says the hole

heating system needs tobe replaced , the landlord says i will never

do that i will see you in court ,1/07 so we went back to court for

not paying the rent , landlords lawyer shows the court Judge ect the

plummers paper that the home needs a new heating system , but i need

to still pay my rent ,And lanlord wants me out , So now its my turn

i explain to the Judge that i have a 2 yr old son , wife living in

a single family home with no heat , other then 12 space heaters ,

this is very hard on my wife cause our son could get burned , our

electric bill is costing us $650.00 - $900.00 a month cause of all

these heaters that we need to keep warm . The law is very clear

every home must have heat .. if it dosnt the landlord dosnt get

rent . and the landlord has shown the court we dont have heat and i

have pictures , the judges reply is well the court can see you dont

have heat .and we have plumming leaks . did you pay the electric

bill , i reply no i cant pay my rent and this huge bill .. well the

judge says in exchange for remarkably low rent rent you dont get

heat , i say judge you rasied my rent more then $950.00 a month .

even thou are rent was paied for the year. we were in a yearly rental

term , the Judge said if you dont like it go to the applet court. so

we paid are rent in full in cash again , then around 3/28/07 back to

court same thing i tell the judge everything but are son has been

getting sick alot , i ask for a hearing so the landlord cant get rent

cause the home has no heating system ,and its the landlords

responibly to make these repairs not the tenant. the judge says you

had it . i will say it again exchange for remarkably low rent you

dont get heat . so you have to pay your rent , but The Judge said i

have to agree its the responiblies of the landlord to make these

repairs at some point.. so again we pay are rent in full in cash in

court. Then 4/07 Newjersey has bad floods are basement gets flooding

about 6-8 inches of water , and then there was the graywater from a

kitchen drain . so we called the landlord's house & office over and

over told left many messages . well about a week later we get a call

from him i tell him everything , flooded basement , kitchen leaks ,

bathroom drain cloged , graywater in basement ect. i tell him we

still have no heat the my wife baby and i are very sick we keep

cleaning up the flooding from all these leaks . there is mold in the

basement and we dont have hot water cause the hot water heater stop .

i said it maybe cause of the water getting so high in the

basement .sheetrock, paneling is comming off walls black mold

behind i told him to remmember what the judge said , i said to him

you drive buy this house to and from work your wife and you all day

we have a pond out front and all that water is comming in the

basement , you have to see it .. he tells me i will have a plummer

come out right away so we keep cleaning up water day after day , 1

week gose buy we keep calling and calling same thing no answer back

then 2 weeks same thing well about 3 weeks after the floods we get a

call from him telling us his plummer will be there the next day i

say great we need this clean up bad there is black mold we sooo sick

the baby my wife and i , well a few days after that the plummer

comes , he can see the house he cant beleave it , the little pump i

bought to try nd pump the basement stop working there was about 4

inches of water . he told me they just got a call to come that day .

i said its been weeks . anyway he looked it over and said he would be

out the next day , he came fixed the kitchen drain & bathroom sink

drain . they left the landlord never sent anyone to clean up the

water mess all are stuff in the basement was garbage we had to try

and cleanthis mess up . well after that our son got soo sick back and

forth to the dr's ear infections ,upper respority infection ,

strept , lung problems , dirarita , stomic pains , tremmors thowing

up , rashes eye infections , tons of things wrong with our son didnt

want to eat in fact didnt gain any weight for 7 months , well arourd

sept 2007 landlord sent us a new lease ,for another year wanting to

raise rent $350.00 more a month , even thou we had all these problems

so back to court i guess , well after talking with people ect .and

another winter comming i went to the town to see if there were any

laws ect ?? i told the building inspector everything no heat ,

plumming leaks black mold . all of us so sick , the building

inspector said whats the address ? i will be right out i told him he

said whats the landlords name? i told him . He said THE Architect i

said yes then the building inspector told me well you need to call

him , i said i have for yrs now , he said well we dont go out

looking at houses , i said 5 mins ago you were going to come right

out what happend he said you need to take this up with your landlord

i said i tried and tried he said i dont know what to tell you then

but were busy and you need to go , i said well i will try the health

dept again . Well i left on the way there i got to thinking my

landlord deals with these people everyday could this be why no one

will help us ???

So i went to the health dept only this time i waited till the very

end to tell them the landlors name , i told her everything she said

she wouldbe out the next day and she was , turns out this woman was

just hired and didnt know anyone , well she came out turns the

NewJersey Health dept dose do single family homes with no heat

plumming leaks . so this is were things kind of turn around she said

landlord will get 5 code violations and she see this black mold and

said to me Wow that looks bad , while she was there in the basement

she had to go out for air 3xs in 20 mins . well i asked her what can

we do about that she said there isnt any laws , But as tenants we

should get it checked out asap at our cost , so we did the next day

we have NEW JERSEY INDOOR ENVIRONMENTAL SCIENCES come out he can

see are son wife dog and i are very sick he looks at everythingdose

all kinds of stuff and saids he will let us know in the next few days

well he calls us and saids we have 4 different kinds of toxic molds

Cladosporium , Aspergillus, and Stachybotrys Chartarum, and they are

letting off gases cause of the on going plumming leaks ,well we have

cout in like a week so i take the report to our landlord laywers

office , we go to court for non payment of rent again , But guess

what a new Judge someone from a different county Great !!! so we go

into the meatation room and the landlord saids i never knew of any

plumming leaks , floods , or problems with the house infact i never

even look inside before , well the only settlement they wanted to

give me was in exchange for 1 month to leave , i would have to give

up my son's wife's and mine right to sue for any personal injury

and property damage we may have .. i said my wife son and i are very

sick i had tons of stuff from doctors , i told him never would i ever

do that his laywer said well it was worth the try.. so we go infront

of the judge they go on and on how my landlord bought this house for

his son to live in . and the landlord wants me out , well now its my

turn i tell the Judge everything and i say it insteresting that they

didnt bring his 5 code violations,with him to court , i tell the

judge look at the landlord regastration statement it says landlord

must make all repairs, we have been living like this for over a

year . let the judge see toxic mold inspection report , i tell the

judge what the health dept did a year ago with the heat and what the

building inspector did as well , the judge coulnt beleave what he was

hearing and i ask the judge if he the landlord wont tell the court

what code violations he has maybe we should have the woman from the

nj health dept come to court so we can all see how my family is

living . The judge ask me what i wanted , after all i have lived in

this home for 4yrs we took are son home from the hospital ect . i

told the Judge i need a month or so to pack are stuff and move cause

we are all sick, the judge said thats more then fair whats the

problem then i told him they wanted me to give up my family's right

to sue , well the judge said he needed to take a 15 min break had to

make some calls i think and the landlord should settle with me cause

we woulndnt be having a case today , well they did got like 35 days

to move . and a very upset landlord ,, Well the woman from the health

dept , The JUDGE WOW!!! someone dose care about my family 9-/07 ,

are mold guy WOW A GREAT MAN THAT DID A INSPECTION FOR ALMOST

FREE !!!! he worked and work to try and get are landlord to clean are

stuff no luck just games , and fights ,, well the landlord ended up

getting dumpsters told us we could use them but he wasnt excepting

any responsibility This was are fault . Well turns out the health

dept had to come back out and here it was getting cold out like

october 12th 2007 maybe .The NewJersey health dept sees more leaks

no plummer came out to date and we still have no heat and were all

living on meds and very sick , the Woman sees ground water comming in

the basement and the tolite leaking in the basement also . i think 2

more code violations,, The landlord calls are home phone while she

is there she tells him everything , he saids there is a tolite in

the basement i didnt know that , even thou he was at the home many xs

infact just 2 days before with his ozone guy .. well she tells him we

need heat , he tells her to tell us to use the eltric space heaters

she says they have a young buy here .. she says you need to call the

local building inspector and ask him was leagal to us for heat ,,

well a few days later we get a phone call from landlors wife it says

you will find 4 space heaters on the front steps to keep warm till

you move out, this is what are local building inspector told them to

use ,, landord sent his plummer to fix some leaks great , ,well

around 10/'22/07 landlords's ozone man come in he wants to do a

treatment we have to leave for the night no $$$ a sick dog ,sick cat

talking bird , my sick wife, 3 yr old so sick fevor rashes , ear

infection, non stop caughing & sneezzing ,itchey , blury eyeys.strep

throat , rashes bruising everywere the 3 of us . mikie's tremmors .

the 3 of us have like restless legs i guess you would call it , bad

ear pains i couldnt spell my name , i coulnt lift my 1 arm /// we

all had this and so much more i could go on for hours and i , so

landlords mold guy checks the mold moisture levels in the house

87% / 82% 77% very high he said i tell himm high this is the 1st time

in i dont know when that this house is getting to dry out ,, he saids

he cant do any Ozone treatments

i was hoping to save some of are stuff .. well i still cant spell

need search to say did u mean??? Well i have worked in 7 -8

months so i sold my truck tools for daily living things $$$ .. Now we

had to move are sons doctor said are son isnt to return to home , so

for the 1st time in my live im homeless broke sick scared and dont

know were to go what to do ??? So for the 1st time in my life i got

to NJ Welfair they will help im sure ,, they play games i tell them

we are homeless ect they say well go to a shelter and then we will

see what we can do but you have to do this 1st . so i call the

shelter place theyset us up in a hotel . with my 3 yr old son , dog ,

cat, talking bird and little mikie's fish . wife & i for 4 days ,then

i have to go in to see them , they maybe able to help with a place

for 6-8 weeks , turns out the shelter wont take anyone with pets , ok

and we need to be working , cause they take 60% of your income save

it till after you move out incase you break things i guess .. how

can anyone save for a place move in a new place on your own if they

are taking 60% of your income while your and your family is sick from

all this toxic mold , and you dont get it back in till you have

already moved . well thats no good , so now Nj Welfair wont help

cause we wont give up are pets & still too sick to work to go into

shelter . this is what help is out there for the working people in

this world that never ask for anything .. well my wifes mothers

says we can stay there till we can find a place she has a small 8x10

bedroom but she too cant have pets in her place so we have tobe

careful ,maybe a few weeks or so . so we move in all of us dog cat

bird fish little mikie . wife & i. then the tires are bald on the car

Thank GOD a local church gets us 2 tires ... Well thank god Mikie is

gaining weight again things are hard cant find work , still sick and

cant seen to think clearly ,still in pain ,and sick not as bad thou,

well a hard Christmas with a 3 yr old , are car has a bad head

gasket , both windows last week fell off there tracks now i have a

screew driver holding the 1 up , andits going to die anytime we are

told , anywere we go we have to take the dog cause mother in law

cant have pets in her place .the dog cant stop peeing every 20-30

mins ,bad skin rashes still and tremmors i guess you call it , i took

him to the vet we have used for 13 yrs told them listen i always

paid in full in cash never left a bill , things are very bad for us

and i cant pay right yet ,they told me unless the dog is dying we

cant help you and they are sorry,, thats that !! we have to be out of

here like yesterday , did find a few houses but after living in a

toxic mold home i look alittle bit and see alot of molds in other

homes , so now i cant even sell are car to get a place and start

over .. I always worked for myself and now i dont know were to turn

im 35yrs old a great wife 3yr old son thats the best kid in the

world , but in at this time i cant seem to provide the min things

they need in life ,, i cant find a home that will take pets they to

are all life our son loves they like brothers and sisters , what do

we do .anyway i wish there wasnt any toxic mold in homes it wrecks

lifes tears familes apart all wee need is a home ,are health, car ,

mold free clothes,if anyone knows were NewJersey people can find any

were that helps people like please let me know , all my wife and i

want is are lifes back , a bed for are son thats mold free this we
