Clarins Expertise 3P Exaggerated Health Claims Submitted to FDA The National Toxic Encephalopathy Foundation (NTEF) has submitted a formal letter of complaint to the Food and Drug Administration (FDA) regarding Clarins Poly Pollution Protection Experts 3P. The letter of complaint references false, misleading advertising and verification of the efficacy and health benefits of the product. “Clarins packaging, package insert and website health claims are being called into questionâ€, said Angel De Fazio, President of the NTEF. Clarins is making “claims of an unprecedented scientific discovery; represents the most advance protection against every type of pollution known today; invisible shield of reinforced protection against all types of pollution we encounter today,†to cite a few. There is no independent scientific methodology that this product’s claims are in fact valid or even recognized by the scientific community. Clarins was taken to task by the United Kingdom’s Advertising Standards Authority in August of 2007. Their final action was “ We told Clarins not to state that electromagnetic waves generated by modern-day devices or domestic communication equipment could damage or age skin or to imply anti-ageing [sic] and pro-health efficacy claims for Expertise 3P unless they held robust scientific evidence to support that. We also told them not to make an undue appeal to consumers fear of the harm that could be caused by man-made electromagnetic waves.†We are now requesting that the FDA verify the claims made by Clarins, in vitro testing versus in vivo testing, along with compliance, since this product is a new drug under section 201(p) of the FDCA, 21 U.S.C. subsection 321 (p), because it is not generally recognized by qualified scientific experts as “ effective†for its intended use.
