Some of the families may be able to afford to take their parents out of this

home and place them in a better home.

The problem with mold not being illegal is that the owners will probably

claim they did nothing wrong.

Even wrongful DEATHS of older people in New York State have trouble

proceeding because, like pets, old people and children, having no income,

the monetary value of their lives is not enough to be 'worth' anything to

lawyers. Lawsuits are a business proposition. Their point is to 'settle'

cases, to resove issues. Not to achieve justice. Thats what things have come

to.

They do not want people taking the law into their own hands (like they used

to) so they have to offer an alternative, even if it is a pathetic one.

If your child is hurt by a truck, and requires continuous medical care for

the rest of their life, then lawyers are interested. But if a child, or

especially an older person dies, there is no lost income to survivors, so no

'cause of action' money wise. So, no interest.

This provides a scary contrast, two accidents, exactly the same, except in

one, a child or unemployed person is killed, the other, maimed. The driver

is completely to blame, maybe they were ignoring a red light. But there is

no premeditated murder.

Which one (or one's family) do you think will find legal representation and

be able to sue?

For old people in New York State the situation is even worse. Its almost as

if there was no recourse. I don't know about product liability law. Maybe

the owners could be fined a few thousand dollars or the people could receive

refunds for a portion of their rents?

Thats about the best they can hope for in New York State.

Nationally, its a similar situation for pets. This is what happened with the

toxic dogfood, remember?
