Second, Workers Compensation cases which date back to the turn of the century when Tort law went to Workers Comp statutes, to make it easier for the worker to collect via an adminstrative system, rather than sue under a tort theory. The UN looks to International Principles of Law for guidance. Any court can look " outside the box " for guidance to make a ruling. When, in 1998, I got sick from mold (aspergillus fumigatus) in my class, I started to research mold; it lead me to the agrarian context. That lead to the Canadian websites for definition. That lead to the European websites. What was in common was the recognition of mycotoxins in the ground, from the shallow buried animal hides (anthrax was among those toxins); what was in the European web for treatment modality. We need to look " outside the box " as you never know what might be helpful to you. The earliest workers comp cases were in the agrarian " exposure " context for baker's lung, farmer's lung, rice workers lung, tobacco worker's lung. OSHA covers many of those exposures.
