Guest guest
Post: Victory for Chemically Sensitive Patient in Court of Appeals Posted by _Ken Dobson_ (http://counsel.net/cgi-bin/chatscripts/mailform.cgi?uid=chv & dmn=tmucdwq-dso.uge\ & name=Ken+Dobson & subject=Victory+for+Chemically+Sens itive+Patient+in+Court+of+Appeals) on 10/01/08 The Oregon Court of Appeals today reversed a trial court that excluded the testimony of Dr. Rea in a case regarding a pesticide misapplication at a house of an individual suffering from chemical sensitivity. Up until this point, almost all reported decsions applying the Daubert test for admissability of expert testimony have exlcuded evidence and testimony regarding the controversial condition. A copy of the Court of Appeals decision is available at: http://www.publications.ojd.state.or.us/A132638.htm Special thanks to Dr. Lipsey, who provided testimony in the Duabert hearing the chemical sensitivity is a recognized disorder. **************Looking for simple solutions to your real-life financial challenges?
