I think the prosecuting attorney summed it best of how Ms. Gallishaw is being persecuted in the name of saving property insurers throughout the US from financial liability when infants perish as a result of exposure to molds in the buildings they insure. Attorney Fineberg is quoted as saying, " ...it also was important to 'debunk the mold theory as the junk science it is.' Fineberg said the jury clearly saw through the defense argument in deciding to find Gallishaw guilty of the endangering charge. " Important to who that Ms. Gallishaw be used to purportedly prove this point? Who has financial interest in this case? Why would hundreds of thousands of taxpayer dollars be used to retry a woman who had already spent time in jail for a child abuse case of nine years ago? Why would the prosecutors need to bring in a high priced, high profile expert..with no background in infant pulmonary hemmoraging from mold...but MUCH background in being paid in controverial cases in desperate need of some creative defense? Dr. Baden was O.J. Simpson's defense expert witness. He is documented as being paid over a quarter of a million dollars in another case as the " expert " witness. There is another case where he is the expert that has been able to determine a 16 year old murder based on the same evidence that no one has been even able to charge the guy with murder. Seems there is a $700K insurance policy involved in that one. What happened to those pictures of the baby's clothes in the moldy basement for those years? Where were they? Why was the " expert " examiner able to rely on hearsay to begin with..and then testify to the validity of it? People should know that when Ms. Gallishaw was oringinally convicted, there was much debate going on in the CDC over the matter. Would have been really bad for the insurance industry if it was found that a mother, who was accused of child abuse, really had a sick baby from mold.. at the same time industry was inserting undue influence over CDC health policy, denying exactly what the mother was claiming for her defense. Who is the real client in this case and why would you waste so much taxpayer dollars on this case if there was not MUCH money at stake by retrying it, even though the mother had already served the time? What is the real story between the lines of this case????? Ms. Fineberg needs to read the new Federal Government Accountability Office Report on the issue that was issued after a two year audit at the request of Senator Kennedy. Pg 5 of the report they discuss pediatric pulmonary hemmoraging from mold exposure. And by the way, the term " junk science " originated with the tobacco industry. It is what they labeled any science that supported cigarettes causes lung cancer. STINKY, STINKY, STINKY. Quit wasting tax dollars denying mold causes serious illnesses while defending the interests of Big Business. This poor woman has obviously been used and abused as a pawn in a much bigger game.
