The meeting was video taped by Fox 45 News and should air tonight.  Senator

Stone and about 6 other Senators were on my side. There were some rental

property managers there that did not want the bill to be passed but the Sentors

did not want to hear that.  I had pictures, my mold test results, and my

testimony to support me.  They are going to sit down and discuss changing

land's law and possibly implement a mold law.

Chante & Darlene,

I don't have the details handy but land passed a mold bill of

sorts last year. Rather than specify levels and types of mold

(impossible), technical procedures (including S520), or when to

compel the remediation of mold, they required independent

accreditation of the qualifications for those inspecting and

remediating mold.

It would have been nice to see you at the meeting yesterday. At this time the

only law that land has that covers tenants is to allow them to put there

rent in escrow under any conditions.  The Senators would like to direct the

landlords to address mold and so this is why they are reviewing the bill and are

going to sit with the property owners to come up with a more specific bill,

Okay, please excuse me to pose a question. An important one..

Your message raised several red flags for me..

There is always a big danger that an " agreeable " " more specific " deal

REDUCES tenant protections in both mold and, non-mold situations!? Is

that perhaps a danger here?

Or in mold situations that did not meet some perhaps intenationally

impossible to meet criteria?

Often, thats the SNEAKYYY way SOME bills work.. Tenants are often in

way over their heads..

The opposition are pros, they know these issues inside and out. They

don't play by any rules.

For example, perhaps NOW tenants can put money in escrow for a bunch

of arguably quite unsafe situations, and THEN later the court decides

whether to give the money to the landlord, or to spend it on

PROFESSIONAL repairs.

But, soon, after a hypothetical state's various interests manage to

get passed a hypothetical " Anti-Mold Tenant Protection Bill " would

the law then say, " they can only do that when the toxin level is above

xxx and the CDC and ACOEM and AAAAI have determined that level to be

unsafe " or something like that?

etc, etc..

Given that the really bad building owners are *terrified* of

contractors they don't have on a very tight leash,

and in my experience, especially of tenants escrow money being used to

*professionally remediate*

(who knows what they might find-) I think that many of the worst

landlords and even slumlords might find that solution QUITE agreeable!

There is a similar law in California, and if you read the fine print,

it limits tenant rights, drastically.

It was hailed as a tenant victory, and most people who did so should

have known better.

Its done absolutely nothing to help, IMO.

I'm also guessing that perhaps some of the worst, say, Baltimore,

multiple bad building owners won't and don't want pros

in their moldy buildings and would do almost anything to avoid that.

Carl, thanks for pointing this out. It will be interesting to see what

comes out of this process.

Lets hope that it doesn't represent one small step forward and two big

steps back.

Chante,

First, let me add my support and congratulations to those who

have already done so.

Second, it may help in your conversations to know that land

is also ahead of many states by adopting a version of a new

section of the International Code Council called the International

Property Maintenance Code. The provisions of which are

enforceable against landlords and property managers. It is the

particularly powerful against absentee landlords. The code

language itself may be modified but if adopted then it is

enforceable. It is my understanding that as of last October they

were the only state to have done so.

Chante, I called Sen. Stone's office today. They gave me the # for my

Senator which is s. Did you know that her husband is in the mold

inspection business? I left my name and a brief story about my exposure to

toxic

mold.

Would it be possible to POST the text of the law here?

I am gathering that both Carl and I share a concern that the law may

give with one hand and take away with the other.

That's my experience how politics often works. Lots of money is often involved.

The PR aspect of politics often is much more dominant than common sense.

Style over substance..

Thats why we have so many problems now.
