Stark II Regs

Hello ListServe Members:

1. I know that self-referral is strictly prohibited among MDs under the

Medicare and Medicaid programs due to Stark II Regs. But is it still a

violation if MDs only refer patients with privare insurance or other

insurances other than Medicare/Medicaid to their own clinic for PT services?

2. Can MDs and PTs be part owners of a clinic with the PT also providing the

PT services but the MD's only role is that of an investor, no referral made

or clinical decision making responsibilities at all? But employs another MD

for instance?
