I started and ran my own practice for 13 years (recently sold). Although I never rented space from an MD I have had discussions with MDs about this. However I did (and currently) rent space to MDs (I own the buildings). Because it is commonly done and it represents a potential abuse situation, the (newly revised and yet pending ) Stark legislation specifically addresses the issue of " Rental Arrangements With Physicians " with regard to certain providers (PT, DME, etc). The legislation breaks down into two broad categories: 1)Potentially Unlawful Activity-several examples are given of rental arrangements that are not necessarily illegal, but should probably be avoided because they will subject you to scrutiny. 2) " Safe Harbors " -these are rental arrangements whereby (if you meet all the requirements), you will be safe from prosecution. If you would like further info, I'll be happy to share what I know.
