Use of aides with Med A and Med B patients in SNF

I am looking for guidance on the use of aides in the SNF. Before PPS began, I could utilize an aide to provide treatments according to my state practice act. Now that Med B patients, in the SNF, fall under CPT coding, does the literature in the CPT code book, indicating Tx must be provided by a therapist, supersede my state practice act. If this is the situation, can someone direct me to the specifics in HCFA's literature.

My other question applies to use of aides with Med A patients. Once again, before PPS I was able to utilize an aide to provide treatments for Med A patients in accordance with my state practice act. Under PPS, does the time an aide spends with a patient count towards RUGS minutes. If they do not, can someone direct me to the specifics in HCFA's literature.

I apologize if this was covered before. Any help would be much appreciated.
