You can, in fact have it tested today under one of the two following conditions: 1) Patient consent to testing and release of results directly to you 2) Magistrates order for testing and release of information, including orders by phone as hospital policies allow There may be more, but I know these are in effect for sure. I've had a patient tested twice for two possible exposures - once as an EMS worker, and once a non-police security officer working for a state police agency (in Texas). If a hospital worker is exposed, and the patient that exposed the worker is still in the facility, they can be tested without the processes that we must go through. If we are exposed to a patients blood / body fluid, and the patient is either in the ER or has been admitted, we CANNOT have the source tested. Again the law states " Health care worker.
