Guest guest Posted January 17, 2008 Report Share Posted January 17, 2008 never sign anything unless u understand every word .. get a lawyers advice .... u shouldn't owe anything u paid for LTD u shouldn't have to pay it back.. u r young don't let them suck u in Rach u deserve what u had coming believe me that is not a lot of money to live on.. and while I'm with u here goodwill has half off everything day every second Saturday even on furniture and if someone is over 55 ;ole your mom or something if they pay with your money its half off every Tuesday here also it might be a different day there and 20 percent off any day it isn't half off..I have gotten Kaytee designer jeans for 1.50 with 200.00 tags still on them... some have clothes for her dogs and cats lol so cute... They said they ''estimate' my ssd payment would be 1100 which is waaaay above what im getting and theyd only pay 232 if they dont get the release within 30days from jan 4th. Guest guest Posted January 18, 2008 Report Share Posted January 18, 2008 , I agree with Rose. You shouldn't have to pay back your ltd. Isn't that a benefit you had with some job in the past? If that was a benefit, it's not something you're supposed to owe if they have to pay out. How long have they been paying you and was there supposed to be a limit on how long you could get the benefits? You really need to go back and look at your benefits package and what the limitations are on the long term disability pay, and whether it says if you receive it for a certain amount of time, you will owe them back. I think the two things are totally separate. You really need some legal advice on this Rach. Can't you find another attorney now that you're in Virginia? There's got to be somebody down there in Danville who handles these sorts of cases. It's a legal question and I'm not a lawyer, but I really do think ltd isn't supposed to have any knowledge or claim to your ssd. They're two separate things. Guest guest Posted January 18, 2008 Report Share Posted January 18, 2008 Hi Without reading the whole release I can't say for sure, but what happened with me is that my LTD asked my permission (signed release) to talk to SSDI worker to find out what the problem was and why it was taking so long. Your SSDI back pay will go into your account. From there you will have to pay LTD. SSDI does not pay LTD. LTD will send you a letter saying how much you were overpaid. Your LTD should of been adjusted after SSDI approved your claim and you started getting SSDI on a monthly basis. SSDI would of sent your LTD a letter stating what your monthly SSDI is. SSDI also should of sent you a letter stating what you were entitled to each year and what the cost of living increase was each year. They also would of told you how much they would be deducting for Medicare part " B " and when Medicare Part A and B would be become effective. Your lawyers fee is subtracted from your total SSDI and then LTD uses the remaining amount to figure what the overpayment to you was. For example: You get $1600.00 per month in LTD. Your SSDI benefit is $800.00 per month before Medicare Part " B " deduction. Your LTD would make up the difference of $800.00 per month so that your monthly benefit is still $1600.00. With me, when all was said and done, my whole back pay from SSDI went to the lawyer and my LTD carrier as overpayment of benefits. I still get paid the same amount now as when I first went on LTD, but it is reduced by what I'm entitled to from SSDI each month. Call your LTD worker and talk with them. They can either explain it to you over the phone or send you a letter of explaination.
