Guest guest Posted December 7, 2007 Report Share Posted December 7, 2007 Listen, I probably missed a lot of this, but as far as the disability goes, lawyers are only allowed to take a specific amount, not to exceed $5700.00. I got $14000.00 back pay, and he only got about $3200.00 of that, my lawyer that is. I got my check long before he did, and I told him he had to call Social Security because it had been 90 days since they had awarded me. I got the check the next monday. It is illegal for them to take more then that, it's like 24% or something like that. I don't know what else he is working on for you, but he should not get paid until you do. If you paid him up front, call the Bar Association and sue his ass. He will get in so much trouble. Also, make sure you contact you're local Social Security office and see if they can help you. If he has to have you sign a release for him to talk to SSDI, how did he work for you anyway? Who has been talking to SSDI in the past? If you don't agree with the decision that was made, ask for a hearing, and tell the SSDI judge exactly what this guy is doing and how much money he is taking. Hope this helps. Guest guest Posted December 7, 2007 Report Share Posted December 7, 2007 Also wanted to tell you if you're SSDI payment is below the poverty level in your area, you automatically qualify for SSI, Food Stamps, and the state will pay you're medicare premium. Make sure you choose a good percription drug plan from medicare, call them and they will help you with that. Some are now charging premiums beginning in Jan., and if you don't make enough, you don't have to pay the premium. And you're co-pay will be between $2.15 and $5.00 per perscription. If this guy took $5000.00 for doing you're Social Security, he is definitely breaking the law. Did you pay him up front? If so, he will be getting a cut from you're back pay also, so you need to call social security and ask them who you need to report him to, and if you do end up suing him, make sure you get him to pay for you're legal fees as well. I'm sorry this happened to you, but don't let him get away with it. He has probably done this lots of times and no one ever challenged him. You can go right to the courts for help, just tell them you are poor and they will give you a financial waver to sign. Guest guest Posted January 2, 2008 Report Share Posted January 2, 2008 YIKES! Whatever happen to the laws they have to adhere to when it comes to SSDI cases??? This one needs to be reported.. It's been awhile since I got my SSDI (14 years?), but as far as I know nothing has changed.. When an attorney agree's to take on a SSA/SSDI case they agree to a few things, 1. they cannot ask for ANY money up front from you. 2. their pay is contingent on whether they win or not. and 3. They can only get up to a certain percentage of your BACK pay! What that amount is I am not sure but I believe it is 20%, they cannot ask you for more.. They work for that amount period! The case is not over until you have your money..THEN he is to get his and not before. Sounds like this guy could be disbarred and I would report him to the SSA and to the Bar Association. I got mine without an attorney.. My mom who started before me, hired an attorney and I got approved before she did and I had nobody helping me.. And I get a piddly amount on top of it..Ticks me off..Less than 600.00 a month, then they take 84.00? for Medicare, and of course I have to have a supplemental health insurance and that is about 140.00 a month.. I have part D, and it goes a little further through my HMO but I have to meet a 250.00 Rx deductible (doesn't take but a couple months) per year, and then part D only covers 99 medications (out of thousands)...Then there is the office call co-pays of 15.00 each. So in the end I am basically using my SSDI to pay for medical...No way I could live on my own..so I am stuck living with my alcoholic dorky ass husband..sorry that just popped out and I don't want to erase it cus it's true..LMAO So don't take any crap from that attorney!!! I got the SSD on my own also. They turned me down the first time and then I was supposed to go to their doctor when I appealed, but before I could do that, they sent me a letter saying I was approved. I don't know how I got so lucky. They also give me some money each month for the kids, but that will stop as each turns 18. My oldest is 16, so we're not that far away, but I anticipate a review in another year or so, and my bipolar is so much better that I'm afraid they'll turn me down for continued benefits. I'm hoping to switch it to a medical payment and not miss any benefits, but with a government agency, you just never know. This last year they didn't even bother to do a review..So maybe they will make me perm. disabled and I wont have to mess with it anymore.. I am better as well..But when I go for review, I don't act like I am because I can't work..I have not worked in 18 years, I am 45 with other health issues and So I don't ever tell them I am any better.. and they don't ask my dr.. I was getting 100.00 a month for my son and he turned 18 last year and they took him right off.. however if they are still in school you can still get it.. I didn't bother because they wanted me to get all this info and papers, etc and 100 bucks wasnt worth it! He just turned 19 Dec 7th and will graduate in '08..
