Suggestion: Make the clause for individual habitability, not just for mold. That way if they spray pesticides at some time, for example, or a neighbor moves in that smokes or cooks spicy food, or uses dryer sheets with fragrance your body can't handle, you can leave without penalty. This makes the decision yours instead of the landlord. By including anything which affects you (habitability) he can't hire a pump jockey to " test for mold " and finding - guess what? - no mold! Also, with a clause like this you don't have to " break the lease. " You are fulfilling the terms of the contract he agreed to. Many won't agree, but hopefully you can find one who will. But after moving into a rental that seemed fine in the cooler weather it was terrible in the summer and I got my doctor to write a note stating it was a medical necessity for me to move out and the landlord complied with no problem. Back on topic... is there anyway to get a month to month lease? Many of the larger apartment complexes wont budge but the smaller ones are more lenient especially after you tell them what the problem is. That worked well so I could test out the unit -- actually the landlord let me stay there for one night so I could get a feeling before signing the lease. I've moved to a new part of the country. I've found most landlords want at least some sort of multi-month commitment. I think I am going to be able to work something out with this owner that if I have a reaction, I can pay one month's rent to leave. I was actually just in a rental that I thought was safe - signed a five-month lease and started reacting like crazy. They forgot they had previously had a leak in there (newish building but we know that doesn't matter). The owner was really nice and let me out of the lease.
