rental agreement with mold stipulation

I've had clients do something like this for years.

Suggestion: Make the clause for individual habitability, not just

for mold. That way if they spray pesticides at some time, for

example, or a neighbor moves in that smokes or cooks spicy

food, or uses dryer sheets with fragrance your body can't handle,

you can leave without penalty.

This makes the decision yours instead of the landlord. By

including anything which affects you (habitability) he can't hire a

pump jockey to " test for mold " and finding - guess what? - no

mold!

Also, with a clause like this you don't have to " break the lease. "

You are fulfilling the terms of the contract he agreed to.

Many won't agree, but hopefully you can find one who will.

I've been through the toxic mold mill for years. Am about to rent a new

apartment and asked landlord if we could add a clause to the lease that

says if mold is found in the unit, I am free to break the lease. Has anyone

here done this? Do you have suggested wording?

Good advice. I know that most landlords won't do this but I am going to try.

I didn't have a clause in my lease. But after moving into a rental that seemed

fine in the cooler weather it was terrible in the summer and I got my doctor to

write a note stating it was a medical necessity for me to move out and the

landlord complied with no problem.

Sorry to stray off topic but Im having that same problem in the house Im

currently living in.

Back on topic... is there anyway to get a month to month lease? Many of the

larger apartment complexes wont budge but the smaller ones are more lenient

especially after you tell them what the problem is.

I have found that individual owners will work with you the most and will

undoubtedly show more compassion toward your situation

I previously had a three-month lease that allowed me to renew month-to-month.

That worked well so I could test out the unit -- actually the landlord let me

stay there for one night so I could get a feeling before signing the lease.

I've moved to a new part of the country. I've found most landlords want at least

some sort of multi-month commitment. I think I am going to be able to work

something out with this owner that if I have a reaction, I can pay one month's

rent to leave. I was actually just in a rental that I thought was safe - signed

a five-month lease and started reacting like crazy. They forgot they had

previously had a leak in there (newish building but we know that doesn't

matter). The owner was really nice and let me out of the lease.

My history was with toxic mold in a condo I owned. I don't know that I would

ever take the risk of owning again.
