Peggy Burton, Health Commissioner for the Portsmouth City Health Department sent a letter to Malone dated January 21 expressing some concerns on how Serv-Pro was cleaning up the mold. " It has come to my attention that Serv-Pro is not following the mold remediation guidelines set forth by the Occupational Safety and Health Administration (OSHA). This causes me considerable concern that the occupants of the building may be exposed to an even greater variety of health effects, " Burton said. " Because measures designed to protect the health of the public, are not being followed it is my recommendation that Serv-Pro follow the procedures they described to City council and in their contract or be let go. " " It's my opinion that the clean-up work done thus far has created more contamination than remediating, " Burton said in concluding her letter. At the Portsmouth City Council meeting on Monday, January 24th Malone asked council what their pleasure was in moving forward. When the city solicited bids for the work two bids were received with Serv-Pro being the best and lowest bid. The city offered to pay Serv-Pro for there services that had been performed. Malone said an invoice was received for less than $2,000. " For this immediate problem (mold in the city building) the best option is to abate the mold, until we can get a conciseness, " Haas Portsmouth City Council President said in an earlier interview. Haas pointed out that earlier in the year the city spent more than $50,000 to replace the roof of the city building. " At some point city council is going to have to pull the plug on this building. We can not keep spending $75,000 dollars here and $50,000 dollars here. I do not know what kind of building we could have had for the $120,000 or the $125,000 that's been spent on this building in maintenance alone, " Haas said. In November council authorized $50,000 for mold remediation. At the time council also requested the health department be involved to ensure the highest of standards are met once the work begins. After some debate council authorized Malone to approach the second bidder to see if they could do the work. The estimated time of completion is 30 days once work resumes. It is NOT a legal or regulatory requirement. I can't believe, or can I?, that a public health department Commissioner would make such a mis-statement. I'd love to be involved in the quality control on this one! I'm betting the overall quality is not better and the cost goes up! Guest guest Posted February 3, 2011 Report Share Posted February 3, 2011 , True - the OSHA policy statement on mold is a technical bulletin, not a standard or regulation. However, employers have an obligation to provide a safe workplace for its employees (general duty clause). Failure to follow recommendations in the OSHA technical bulletin can certainly be viewed as a breach of duty on the party of the mold remediation contractor to its employees. The city has a responsibility to the employees of the building. Although the Commissioner's statement might not be technically correct, if work practices do not minimally protect the remediator's employees, they are not likely to protect the building employees and public visitors.
